A. 
Permitted Uses. A building or lot shall be used only for the following purposes:
1. 
Single-family dwellings (not to include mobile homes).
2. 
Customary home occupations.
3. 
Public utilities.
4. 
Municipally-owned or operated parks and playgrounds.
5. 
Farms, truck gardens and nurseries, and buildings pertinent to such operations.
6. 
Schools, both elementary and secondary.
7. 
Churches.
8. 
Private clubs.
9. 
Cemeteries, including mausoleums.
10. 
Accessory buildings.
11. 
Commercial applications such as listed in Section 405.080(A).
B. 
Area Requirements.
1. 
The minimum lot area for residential use is fifteen thousand (15,000) square feet; the minimum lot area for non-residential use is twenty-one thousand eight hundred (21,800) square feet.
2. 
Minimum lot width at front yard line 75 feet
3. 
Minimum yard requirements:
a. 
Front depth: 30 feet
b. 
Side depth: 10 feet
c. 
Rear depth: 50 feet
C. 
Off-Street Parking. Off-street parking facilities shall be as required in Section 405.100.
D. 
Annexation Provisions. All territory which may hereafter be annexed to the Village of Theodosia shall be classified initially as "A". Within one (1) year of the effective date of such annexation, the territory in question shall be appropriately classified in accordance with the provisions of these regulations.

2. 
Customary home occupations.
3. 
Municipally-owned or operated parks and playgrounds.
4. 
Public schools and similar educational facilities.
5. 
Churches.
6. 
Group homes. No group home shall be located within two thousand five hundred (2,500) feet of another group home. The exterior appearance of the home and property shall be in reasonable conformance with the general neighborhood standards. Group homes shall be eleemosynary or not-for-profit in nature.
7. 
Accessory buildings for the uses above when located not less than sixty (60) feet from the front line and not less than six (6) feet from any side lot line.
8. 
Temporary buildings for uses incidental to construction work, which buildings shall be removed upon the completion or abandonment of the construction work.
9. 
Accessory buildings as defined in the Code may be placed on a lot other than the lot of the principal residence so long as:
a. 
The lot adjoins the lot of the principal residence and is owned by the same party.
b. 
The accessory building is constructed of the same material as the principal residence unless otherwise approved by the Zoning Board of Adjustment.
c. 
Accessory building shall be no larger than twenty-four (24) feet by thirty (30) feet and walls no higher than ten (10) feet.
d. 
No metal polebarns allowed in "R-1" residential district.
e. 
Accessory building must be sold with the principal residence to the same party.
B. 
Area Requirements.
1. 
The minimum lot area for lots created for residential uses after the date of this Chapter shall be seven thousand two hundred (7,200) square feet, and the lot shall have a minimum width of seventy (70) feet.
2. 
Single-family dwelling shall have a minimum space of one thousand two hundred (1,200) square feet of heated living space on the first floor living level of the home excluding decks, porches, and garages with the exception of Marina Hill project of eighty (80) proposed vacation homes which may be six hundred ninety-eight (698) square feet.

Off-Street Parking Regulations. Off-street parking facilities shall be as required in Section 405.100 of this Chapter.

Water Supply. No individual water supply system for human consumption shall be permitted on any lot unless such system is located, constructed, and equipped in accordance with the requirements, standards, and recommendations of the Missouri State Board of Health, approval of such system as installed to be obtained from such authority.
E. 
Sewage Disposal. No individual sewage disposal system shall be permitted on any lot unless such system is located, constructed, and equipped in accordance with the requirements, standards, and recommendations of the Missouri State Board of Health, approval of such system as installed to be obtained from such authority.
F. 
Prohibited. No animals, livestock or poultry of any kind shall be raised, bred, kept on any lot, except two (2) dogs, two (2) cats, or other household pets, provided they are not kept, bred, or maintained for any commercial purpose.

Accessory buildings for the uses above when located not less than sixty (60) feet from the front line and not less than six (6) feet from any side lot line.
8.

Accessory buildings as defined in the Code may be placed on a lot other than the lot of the principal residence so long as:
a.

B. 
Height Regulations.
1. 
No building shall exceed the lesser of thirty-five (35) feet or two and one-half (2½) stories in height.
2. 
Steeples, chimneys and other purely ornamental or mechanical uses shall not be considered for purposes of determining building height.
C. 
Area Requirements.
1. 
The minimum lot area for single-family and all non-residential uses shall be seven thousand two hundred (7,200) square feet, and the lot shall have a minimum width of seventy (70) feet. The minimum lot area for single-family detached and multiple-family uses shall be one thousand five hundred (1,500) square feet for each unit and the lot shall have a minimum width of sixty (60) feet.
2. 
Yard requirements (minimum).
a. 
Front depth: 30 feet
b. 
Side depth: 10 feet
c. 
Rear depth: 30 feet
D. 
Mobile Home Park. Any mobile home park located in District "M-1" shall conform to the following requirements:
1. 
The park shall be located on a well drained site, properly graded to insure rapid drainage and freedom from stagnant pools of water;
2. 
Mobile home spaces shall be provided consisting of a minimum of two thousand four hundred fifty (2,450) square feet for each space, which shall be at least thirty-five (35) feet wide and clearly defined;
3. 
Mobile homes shall be at least fourteen (14) feet in width, and shall be so harbored on each space that there shall be at least a fifteen (15) foot clearance between mobile homes;
4. 
All mobile home spaces shall abut a driveway of not less than twenty (20) feet in width, which shall have unobstructed access to a public street;
5. 
At least one (1) vehicle parking space of two hundred (200) square feet shall be provided on each mobile home space; and
6. 
An electrical outlet, water and sanitary sewer shall be provided at each mobile home space.
E. 
Off-Street Parking Regulations. Off-street parking facilities, other than those established for a mobile home park above, shall be as required in Section 405.100 of these regulations.
F.

Eating establishments; cafes and restaurants.

Retail stores.

Retail factory outlet shops.

Mobile homes prohibited.
B. 
Conditional Uses. Upon prior issuance of a special permit by the Board of Zoning Adjustment in accordance with the special permit procedures set forth in Section 405.120 of these regulations, the following uses shall be permitted:
1. 
Lumberyards, farm stores and similar facilities requiring open storage (but not salvage yards).
2. 
Veterinarian, animal hospital.
3. 
Warehousing.
4. 
Wholesale establishments.
C. 
Height Regulations.
1. 
No building shall exceed the lesser of thirty-five (35) feet or two and one-half (2½) stories in height.
2. 
Steeples, chimneys and other purely ornamental or mechanical uses shall not be considered for purposes of determining building height.
D. 
Area Regulations.
1. 
The minimum lot area shall be seven thousand five hundred (7,500) square feet, with a minimum width of seventy-five (75) feet.
2. 
The minimum depth of front yards shall be thirty (30) feet.
3. 
The minimum depth of side yards shall be ten (10) feet.

The minimum depth of rear yards shall be thirty (30) feet, except when a lot rear yard line abuts a residential area, in which case the minimum depth of rear yard shall be fifty (50) feet.
E. 
Off-Street Parking Regulations. Off-street parking facilities shall be as required for specific uses in Section 405.100 of these regulations.
