Editor's Note: This local law also redesignated former Articles VIII and IX as Articles IX and X, respectively.
As used in this article, the following terms shall have the meanings indicated:
PRIVATELY OWNED FIRE HYDRANTS
Fire hydrants located within the Village that are owned by any person, partnership, corporation, or entity other than a federal, state, county or local municipal corporation or government, or United Water or any of its successors or assigns.
SNOW MARKER
An approximate four-foot-tall pole, stick, or marker that is affixed at or near the top of a fire hydrant in order for the fire hydrant to be seen and located by emergency responders whenever the fire hydrant may be covered by snow or ice.
A. 
Privately owned fire hydrants shall be appropriately designated on site plans.
B. 
Privately owned fire hydrants shall be registered with the Village of Airmont Fire Inspector or other designated official.
C. 
Privately owned fire hydrants shall comply within criteria established in fire hydrants by the New York State Fire Prevention and Building Code and/or NFPA.
D. 
Privately owned fire hydrants shall be acceptable to local fire departments and contain two National Standard Thread (NST) parts compatible for use by said Fire Departments.
E. 
Owners, occupants and tenants of property on which privately owned hydrants are located shall maintain clear access to the same, keeping said hydrants clear of all obstructions and protect them from vehicle traffic and other hazards.
F. 
All privately owned fire hydrants shall be painted a bright yellow color, except for the top of said hydrants, which shall be painted a silver color.
G. 
During the period beginning November 15 and ending on April 15 each and every year, all owners, occupants and tenants of property upon which one or more privately owned fire hydrants lie shall cause to be installed and maintained on each and every such hydrant a snow marker.
H. 
Owners, occupants and tenants of property upon which one or more privately owned fire hydrants lie shall cause all of the following to occur on an annual basis with regard to each and every such hydrant:
(1) 
Inspection, maintenance and flow testing as set forth in a form to be provided by the Office of the Fire Inspector. Said report shall be completed and delivered to the Office of Fire Inspector within 10 days of the completion of the required annual inspection, maintenance and flow testing.
(2) 
Inspection after each operation
I. 
Provisions of the Fire Code of New York State, as well as any county, state, and federal laws or regulations, relating to privately owned fire hydrants shall remain in full force and effect within the Village of Airmont, and shall be in addition to the above. To the extent that there is any conflict between this Code and that contained within the Fire Code of New York State or any county, state, or federal law or regulation, the more restrictive provision shall apply.
