[HISTORY: Adopted by the Board of Trustees
of the Village of Fayetteville 4-24-1972 as Art II of Ch. 7 of the
Code of Ordinances (1972). Amendments noted where applicable.]
The Fire Chief shall have general supervision
and control of all Village fire apparatus and equipment.
The Fire Chief shall be in full charge at all
fires, and in his absence, the Assistant Chief in the order of rank
and promotion shall be in full charge thereof; and no orders shall
be taken from any person except the Chief or his Acting Assistant.
All firemen shall report to the Chief or Acting
Chief before leaving any fire.
All firemen shall report at the engine house
for practice at any time when so ordered by the Chief.
All firemen shall accompany the fire apparatus
and equipment to the engine house after each fire and shall return
their boots, coat and hat forthwith.
It shall be the duty of the members of the Fire
Department to respond promptly when notified of any fire, and any
fireman failing to report to the Chief or his Acting Assistant shall
not receive pay.
In responding to any alarm, the driver first
at the engine house shall drive the engine to and from the fire and
shall remain with the engine during the fire unless otherwise ordered
by the Chief or his Acting Assistant.
It shall be the duty of the Chief of Police
to rope off any burning buildings, and he shall have full charge of
regulating traffic in the street.

Fire safety inspections of buildings and structures as well as property maintenance inspections that relate to fire safety can also be performed by a member of the Fire Department who is a certified Code Enforcement Officer or a certified Code Compliance Technician in accordance with Local Law No. 2 of the year 2008, which amended Chapter 78 by adding subsection H to § 78-8 of the Codes of the Village of Fayetteville.

In accordance with the Fire Code of the State of New York, Chapter 1, General Requirements, Section 110, Code Enforcement Official Notification, the Fire Chief, Assistant Chief or Incident Commander shall notify the Codes Enforcement Officer of the Village of Fayetteville of any fire or explosion involving any damage to the structural components, electric wiring, electric or fuel-burning appliance, and/or chimney, flue or gas vent.
A.
If in the opinion of the Fire Chief, Assistant Chief or Incident
Commander, the extent of the damage of the structure(s) at the fire
scene may be such that the structure(s) may be unsafe or unfit for
human occupancy, but this damage does not involve at structural damage,
the Fire Chief, Assistant Chief or Incident Commander can request
the Codes Enforcement Officer to come to the fire scene to render
his opinion as to the extent of the damage and whether or not the
structure is unsafe or unfit for human occupancy.
B.
If the Fire Chief, Assistant Chief or Incident Commander requests
the Codes Enforcement Officer to come to the fire scene, at least
one member of the fire department and the appropriate emergency vehicle
shall remain at the fire scene until the Codes Enforcement Officer
makes a determination whether or not the structure is unsafe or unfit
for human occupancy and posted accordingly.
C.
If the Fire Chief, Assistant Chief or Incident Commander does not
request the Code Officer to come to the fire scene, but there was
damage to the structural components, electric wiring, electric or
fuel-burning appliance, and/or chimney, flue or gas vent, the address
of the structure and nature of the incident will be provided in writing
to the Codes Enforcement Officer within 24 hours of the incident via
e-mail or other acceptable means and the timeline to be the close
of the day shift, the next business day.

The owner of the property and/or structure on the property is
responsible for complying with the New York State Uniform Fire Prevention
and Building Code and the Code of the Village of Fayetteville where
applicable.

Fire hydrants shall be installed at locations determined by
the Village of Fayetteville's Fire Department in all areas in
which commercial, industrial buildings, churches, schools, public
multi-dwelling rest homes and other such buildings are located, in
accordance with the rules and regulations of this chapter.
A.
The Village of Fayetteville's Fire Department will review and
approve or disapprove the plot plan for the location(s) of a fire
hydrant(s). This approval or disapproval will be filed with the Village
of Fayetteville's Planning Board prior to the applicant's
hearing, if any. If no hearing is required, the approval or disapproval
of the Fayetteville Fire Department will be filed with the Village
of Fayetteville's Office of Code Enforcement prior to the issuance
of any building permit.
B.
Required distances.
(1)
At any given intersection of a residential development shall be no
more than 250 feet (reduced by 50 feet for dead-end streets) between
hydrants (assuming a fire flow requirement of 1,750 gallons or less
per minute).
(2)
For all other locations located on an New York State's DOT or
Onondaga County's DOT highway, a fire hydrant shall be located
on the same side of the street where the building is located with
an average spacing of 250 feet (reduced by 50 feet for dead-end streets)
between hydrants (assuming a fire flow requirement of 1,750 gallons
or less per minute).
C.
A copy of the final plot plan with the proposed hydrant locations
shall be left with the Village of Fayetteville's fire department
for its future reference.
D.
Number and location of fire hydrants: The following table shall be
used in determining the number and location of fire hydrants, the
location to be designated by the fire chief:

E.
Fire hydrant and pipe materials and installation. Fire hydrant and
pipe materials and installation shall be in conformance with the Onondaga
County Water Authority Construction Specifications.
F.
Size of water mains and fire hydrant connections. New installations
of water mains shall not be smaller than 12 inches unless the Village
Board of Trustees determines that, under the circumstances, a smaller
water main is appropriate. The connection and gate valve shall be
the same as for a twelve-inch main. The sidewalk flange must be level
with the finished grade. Nozzles are to face the street or away from
the building. Where an existing water main is smaller than six inches,
the fire hydrant lateral connection and gate valve shall be the same
as for an eight-inch main.

Where access to or within a structure or an area is restricted
because of secured openings or where immediate access is necessary
for life-saving or fire-fighting purposes, the Fire Chief or his designated
fire inspector may request the owner and/or tenant of the structure
or area to install a key box approved by the Village of Fayetteville
in accordance with the Fire Code of New York State, Chapter 5, Fire
Service Features, Section 506, Key boxes.
A.
If the owner and/or tenant of the structure or area refuses to install
the requested key box, the Fire Chief or his designated fire inspector
may request the Codes Enforcement Officer to direct the owner and/or
tenant of the structure or area to install the requested key box as
authorized by the Fire Code of New York State, Chapter 5, Fire Service
Features, Section 506, Key boxes, Paragraph 506.1, Where required.
B.
Under circumstances and with the approval of the Fire Chief or his
designated fire inspector, a key box may not be required, subject
to an appropriate release form being given to the Village of Fayetteville.

No person shall stop, stand or park a motor vehicle or trailer,
or place any other obstruction within a fire lane.
A.
If a motor vehicle, trailer or obstruction is in a fire lane at the
time of a fire or emergency, the Fire Chief, Assistant Chief or Incident
Commander at a fire or emergency scene may request the authorized
police agency or Codes Enforcement Officer to remove the motor vehicle
or trailer or obstructions from the fire lane.
B.
If a motor vehicle, trailer or obstruction is in a fire lane at the
time of a fire or emergency, and in the opinion of the Fire Chief,
Assistant Chief or Incident Commander the motor vehicle, trailer or
obstruction endangers fire or emergency personnel or hinders fire
or emergency personnel in their duties, the Fire Chief, Assistant
Chief or Incident Commander may remove the motor vehicle or trailer
or obstructions from the fire lane using whatever means is necessary.
C.
If a motor vehicle, trailer or obstruction is in a fire lane, but
there is no fire or emergency at that time, the Fire Chief, Assistant
Chief or officer in charge may request the authorized police agency
or Codes Enforcement Officer to ticket and/or remove the motor vehicle
or trailer or obstructions from the fire lane.

A.
Any temporarily unoccupied building, structure, premises or portions thereof, including tenant spaces determined by the Codes Enforcement Officer to be unsafe pursuant to § 107, Unsafe Structures and Equipment, and § 108, Emergency Measures, of the Property Maintenance and Fire Codes of New York State, § 311 of the Fire Code of New York State, and/or §§ 55-5, 55-6, and 55-7 of the Code of the Village of Fayetteville, shall be placarded.
(1)
The placard(s) shall be applied on the front of the structure and
be visible from the street. Additional placards shall be applied to
the side of each entrance to the structure and on penthouses.
(2)
Placard(s) shall be marked as required by Section 311.5.2 through
311.5.4 of the Fire Code of New York State.
(a)
The markings on the placard shall be informational only and
shall not in any way limit the discretion of the on-scene incident
commander.
(3)
The cost and expense of the placard(s), including the installation
of the placard(s), shall be invoiced to the owner of the property.
Said cost and expense may be charged as a lien against the real property.
B.
Any temporarily unoccupied building, structure, premises or portions thereof, including tenant spaces determined by the Codes Enforcement Officer to be unsafe pursuant to § 107, Unsafe Structures and Equipment, and § 108, Emergency Measures, of the Property Maintenance and Fire Codes of New York State, § 311 of the Fire Code of New York State, and/or §§ 55-5, 55-6, and 55-7 of the Code of the Village of Fayetteville, shall have a key box.
(1)
The key box shall be a secure device with a lock operable only by
a Fire Department master key, and containing building entry keys and
other keys that may be required for access in an emergency.
(2)
The key box shall be installed at a location of the temporarily unoccupied
building, structure, premises or portions thereof, including tenant
spaces determined by the Chief of the Fayetteville Fire Department.
(3)
The cost and expense of the key box, including the installation of
the key box, shall be invoiced to the owner of the property. Said
cost and expense may be charged as a lien against the real property.

Any person committing an offense against any of the provisions of this chapter shall be guilty of a violation and, upon conviction thereof, shall be punishable for each offense by a fine or by imprisonment as set forth in Chapter 113 of this Code.
