A. 
The Animal Control Officer, Codes Enforcement Officer, or a police officer observing a violation of this chapter in his presence shall issue and serve an appearance ticket pursuant to the Criminal Procedure Law.
B. 
As to the control of animal waste, the Animal Control Officer, Codes Enforcement Officer or a police officer shall, and any member of the Village Board of Trustees may, after observing a violation of this chapter or upon the sworn complaint of an individual observing a violation of this chapter, issue and cause to be served an appearance ticket setting forth a brief description of the circumstances of the violation.
C. 
The return date on the appearance ticket issued under this chapter shall be no sooner than 10 days, including the day of service, from the date of service.
Any person who observes a domestic animal, farm animal, poultry, other animal or exotic animal, or the owner(s) thereof, in violation of any of the provisions of this chapter may file a written verified complaint with the Animal Control Officer, Codes Enforcement Officer, or a police officer in a form acceptable to the Animal Control Officer, Codes Enforcement Officer, or a police officer, which complaint shall set forth the conduct of such domestic or exotic animal or that of the owner, including the date thereof, the damage caused, if any, a description of such domestic animal, farm animal, poultry, other animal or exotic animal and the name and residence, if known, of the owner of said animal. Upon receipt of such a complaint, if such complaint indicates that a violation of this chapter has occurred, the Animal Control Officer, Codes Enforcement Officer, or a police officer shall issue and serve an appearance ticket based upon such information upon the owner of such domestic animal, farm animal, poultry, other animal or exotic animal, if such owner is known.
Any person who violates any of the provisions of this chapter shall be guilty of a violation pursuant to the Penal Law and, upon conviction thereof, shall be subject to the fines, penalties and other provisions set forth in Chapter 113. The provisions hereof are in addition to the regulations, restrictions, requirements and penalties contained in Article 7 of the Agriculture and Markets Law of the State of New York.
Any person who observes a domestic animal, farm animal, poultry, other animal or exotic animal in violation of any section of this chapter may file a signed complaint with the Animal Control Officer, Codes Enforcement Officer, or a police officer, specifying the violation, the date of violation, the damage caused, and including the place the violation occurred and the name and address of the domestic animal's, farm animal's, poultry's, other animal's, or exotic animal's owner, if known.
The Animal Control Officer, Codes Enforcement Officer, or a police officer shall have authority, pursuant to Article 150 of the New York Criminal Procedure Law, to issue appearance tickets as defined therein for the purpose of enforcing this chapter.
A. 
Knowing violations. Any owner, person, corporation, association or other organization or entity that violates any applicable provision of this chapter which references penalties for a knowing violation shall, severally, for each and every such violation, be guilty of a violation punishable by a fine of not more than $1,000. Each day that the prohibited condition(s) or such violation continues shall constitute a separate offense.
B. 
Other violations. Any owner, person, corporation, association or other organization or entity that violates any applicable provision of this chapter, other than those which reference penalties for a knowing violation, shall, severally, for each and every such violation, be guilty of a violation punishable as follows:
(1) 
For conviction of a first offense, a fine not exceeding $350 or imprisonment for a period not to exceed six months, or both.
(2) 
For conviction of a second offense, both of which were committed within a period of five years, a fine of not less than $350 nor more than $700 or imprisonment for a period not to exceed six months, or both.
(3) 
For a third or subsequent offense, all of which were committed within a period of five years, a fine of not less than $700 nor more than $1,000 or imprisonment for a period not to exceed six months, or both.
(4) 
Each week that the prohibited condition(s) or violation continues shall constitute a separate offense.
C. 
The imposition of one penalty for any violation shall not excuse the violation nor permit it to continue. The imposition of any such penalty shall not be held to prohibit the enforced removal of prohibited conditions by any appropriate remedy, including immediate application for an injunction.
D. 
An action or proceeding in the name of the Village of Fayetteville, New York, may be commenced in any court of competent jurisdiction to compel compliance with or restrain by injunction the violation of any provision of the Uniform Code, this chapter, any rule or regulation adopted pursuant to this chapter or any order issued pursuant to this chapter. Such remedy shall be in addition to penalties otherwise prescribed by law.
E. 
Nothing in this chapter shall preclude any action or proceeding based upon any other remedies or penalties provided under state or other laws, ordinances or regulations, including but not limited to New York State Executive Law § 382.
F. 
For purposes of conferring jurisdiction upon courts and judicial officers generally, violation of those provisions which reference penalties for a knowing violation shall be deemed violations, and for such purpose only, all provisions of law relating to violations shall apply.
G. 
For the purpose of conferring jurisdiction upon courts and judicial officers generally, violation of provisions of this chapter, other than those which reference penalties for a knowing violation, shall be deemed misdemeanors, and for such purpose only, all provisions of law relating to misdemeanors shall apply to such provisions.
No person shall hinder, resist or oppose the Animal Control Officer, Codes Enforcement Officer, or a police officer to administer or enforce the provisions of this chapter in the performance of the duties under this chapter.
The owner or harborer of any domestic animal, farm animal, poultry, other animal and exotic animal so destroyed under the provisions of this chapter, whether destroyed by the Animal Control Officer, Codes Enforcement Officer, or a police officer or released to an authorized humane society or veterinarian, shall not be entitled to any compensation and no action shall be maintainable thereafter to recover the value of such dog or any other type of damage.
A. 
This chapter shall not relieve or reduce any other requirements of the Code of the Village of Fayetteville.
B. 
If any provision, sentence, clause, section or part of this chapter is for any reason found to be unconstitutional, illegal or invalid, such finding shall not affect or impair any of the remaining provisions, sentences, clauses, sections or parts of this chapter. It is hereby declared to be the intent of the Village of Fayetteville Board of Trustees that this chapter would have been adopted had such unconstitutional, illegal or invalid provision, sentence, clause, section or part not been included herein.
C. 
This chapter shall take effect 10 days after filing with the Secretary of State of the State of New York.
