The purpose of this chapter is to create a Stormwater Management Overlay District in the Town of Elma, which shall be used and/or enforced with in conjunction with Local Law No. 3-2007[1] and Local Law No. 4-2007.[2]

Editor's Note: Local Law No. 4-2007 was repealed and replaced by L.L. No. 2-2015 which amended Ch. 52, Building Construction; Ch. 82, Flood Damage Prevention; Ch. 117, Site Plan Review; Ch. 123, Subdivision of Land; and added a new Ch. 120, Stormwater Management.
The provisions of/requirements of Chapter 120, Stormwater Management, of the Code of the Town of Elma shall apply to any and all construction activities that take place in the Stormwater Management Overlay District, and the requirements and prohibitions set forth in Article XV of Chapter 115, Sewers, of the Code of the Town of Elma, shall apply to property within the Stormwater Management Overlay District and to water entering the Stormwater Management Overlay District.
All the lands/properties of Town of Elma shall be affected by this chapter. A Stormwater Management Overlay District Map shall be maintained and amended when necessary by the Town of Elma Building Inspector.
