[HISTORY: Adopted by the Mayor and Council of the Borough of Hopatcong 11-2-1967 as Ch. 58 of the 1967 Code. Amendments noted where applicable.]
Whereas, at the election held November 5, 1963, there was submitted to the voters of the Borough of Hopatcong, in the County of Sussex, hereinafter referred to as "said municipality," the question of whether or not the said municipality should adopt the provisions of the Civil Service Act of the State of New Jersey, and said adoption was duly approved and authorized by a majority of the voters of said municipality at said election; and
Whereas, immediately thereafter, the Civil Service Commission of the State of New Jersey made a survey of all municipal officers and employees covering the duties and respective departments of said employees of said municipality; and
Whereas, following such a survey, the Civil Service Commission has submitted to the governing body of the said municipality three separate and distinct schedules, as follows:
Schedule 1. Being a list of employees in the jurisdiction with their dates of original and present appointments, salary and title, and their proposed status, title and divisional classification.
Schedule 2. Being class specifications in alphabetical order, including definitions, examples of work, educational and experience requirements, and knowledge and abilities.
Schedule 3. Being an alphabetical list of titles of full-time positions in the classified service with proposed salary ranges and divisional classifications, also of part-time positions, a schematic list of titles of full-time positions in the classified service, with proposed salary ranges, a descending list, etc.
Now, therefore:
Schedules 1 and 2 referred to herein and filed with the Borough Clerk coincident with the introduction of this article be and they are hereby made a part of this article, except that in Schedule 1 the proposed title of position of Administrative Secretary shall be changed to Administrative Assistant, Division C, and the title and classification shall exist as long as the present incumbent holds the position; and the specifications for the position of Public Works Repairman be amended to include in both the definition and examples of work the clause "engages in the collection of trash"; and principal cashier shall be entitled "Cashier"; with definition, etc., as set forth in attached rider to the survey made by New Jersey Civil Service Commission.
Schedules 1 and 2 of the Board of Health Survey made by the a Civil Service Commission of the State of New Jersey, and said survey being filed with the Borough Clerk coincident with the introduction of this article, be and they are hereby made a part of this article.
All ordinances or parts of ordinances inconsistent herewith are repealed, excepting the present salary ordinances[1] and the ordinance creating the office of Administrative Assistant,[2] which ordinances shall remain in full force and effect in the Borough of Hopatcong.

The Mayor and Council reserve the right to pay a salary to any new employee during his or her six-month probationary period, which may be less than the minimum rate of salary or compensation as hereinabove provided. However, upon the satisfactory completion of such probationary period, said employee shall be paid not less than the minimum salary provided for the particular office or employment.
The Mayor and Borough Council further reserve the right to pay a salary to any new employee at any figure between the minimum and maximum salary provided for such office or position and not necessarily the minimum salary.
A. 
The adoption of this article shall not operate to either increase or decrease the present pay of any officer or employee of the Borough of Hopatcong, and the salaries or compensations provided by existing ordinances shall remain in full force and effect until such time as the Mayor and Borough Council may, by resolution, grant and approve such additional increments of salary pursuant to the terms of this article.
B. 
The Mayor and Council shall, upon the adoption of this article, adopt, by resolution, a salary guide setting forth the annual increments to be paid to each class of position or employment within the minimum and maximum limitations herein provided. The increment payments contained herein shall be contingent upon the availability of funds and shall operate to provide increments only to those employees who have satisfactorily performed the duties of their positions.

As used in this article, the following terms shall have the meanings indicated:
FULL-TIME EMPLOYEE
An employee appointed to a Borough position who has served the required probationary period and who works at least 32 1/2 hours per week and receives all benefits.
PART-TIME EMPLOYEE
An employee whose average hours of duty are less than 32 1/2 hours per week.

PROBATIONARY EMPLOYEE
An employee whose permanent status is pending satisfactory completion of the probationary period and who receives no benefits until the probationary period is completed.

A. 
Every officer or employee of the Borough of Hopatcong not covered under a bargaining unit agreement or separate employment agreement shall be entitled to annual vacation time with pay based upon the following schedule:

B. 
Those employees covered under a bargaining unit agreement shall receive vacation pay as prescribed in the agreement.
C. 
Vacation benefits shall be computed as of January 1 of the calendar year. New employees hired after January 1 of the calendar year shall accrue one day's vacation benefit for each full month of service during the calendar year. Employees on the payroll as of January 1 of any calendar year shall on that January 1 to be credited in advance with vacation entitlement in accordance with the foregoing schedule; provided, however, that if the employee works less than 12 months in the calendar year, he is only entitled to a pro rate share of such vacation entitlement. Vacation leave credits shall continue to accrue while an employee is on leave with pay, except that vacation benefits shall not accrue for time during which the employee is receiving benefits under § 43-26 (workers' compensation), nor for any time the employee is on leave without pay. An employee who has used more vacation time than he is entitled to at the time of his severance shall have an amount equal to his daily rate of pay deducted from his final pay for each day of vacation he has used in excess of the number of days to which he is entitled.

D. 
Reasonable effort shall be made to accommodate employees' request for vacation time; however, the responsibilities of the position and the welfare of the Borough shall take precedence.

E. 
Employees shall submit requests for vacation time by March 15. Vacation time submitted after March 15 must be submitted four weeks prior to the requested time off and will be considered on a first-come, first-served basis. For vacation requests for the time period from January 1 through March 15, the request must be submitted at least four weeks prior. Employees may utilize up to five days on a single basis each year; these requests must be submitted at least three working days in advance.

F. 
Vacation days must be utilized during the calendar year in which they are accrued, with the exception that unused vacation days may be requested in writing to the employee's supervisor and approved by the Borough Administrator, that the pressure of work or illness warrants an extension, and carried forward and utilized during the first quarter of the next succeeding calendar year.

G. 
Employees that have vacation balances for vacation time earned prior to 1994 will be required to utilize at least five days of the previous balance each year until the balance is exhausted.

Ordinance No. 7-2003, adopted 5-7-2003, provided that, for 2003 only, General Election Day be deleted as a holiday and that the day after Christmas be added as a holiday.
B. 
The employee must notify the Administrator of his intent to take his holiday of choice in advance of the holiday.
C. 
When a holiday falls on a Saturday, it shall be observed on the preceding Friday. When a holiday falls on a Sunday, it shall be observed on the following day, Monday.
D. 
No additional days are to be taken as holidays, unless designated by the Mayor, regardless of their designation by any other legal entity.
E. 
Those employees covered under a bargaining-unit agreement shall receive holiday pay as prescribed in the agreement.

Longevity shall be paid pursuant to the terms and conditions of a collective bargaining agreement to those members of a bargaining unit specifically covered.

The following supervisory titles shall be eligible for longevity: Public Works Superintendent, Assistant Public Works Superintendent, Public Works Supervisor, Water/Sewer Operator, Chief of Police, Municipal Court Administrator, Municipal Clerk, Borough Administrator, Tax Collector, Tax Assessor, Chief Finance Officer, Purchasing Agent, Recreation Activities Coordinator, Construction Official, Zoning Officer, Health Officer, Registered Environmental Health Specialist, Public Health Nurse.
B. 
The longevity schedule for the titles listed in Subsection A herein shall be as follows:

C. 
The above longevity schedule shall commence upon the employee’s successful completion of 10 consecutive years of full-time employment with the Borough of Hopatcong. Eligible employees shall receive a lump-sum payment of the corresponding longevity amount during the first payroll of December of each year for years in which they shall attain eligibility for longevity on or before December 31 of said year. Longevity shall not be pensionable and shall not be included as part of employee’s base salary for the calculation of future cost-of-living salary adjustments. Employees resigning or retiring on or before the first payroll of December shall not be eligible for longevity payment for that year.

All regular part-time and full-time employees whose salaries are covered under § 43-6A and B shall be entitled to dental insurance coverage as provided by the Borough and more fully described in the Borough's Personnel Manual.

All regular full-time employees whose salaries are covered under § 43-6A, and all regular part-time employees whose salaries are covered under § 43-6B, shall be entitled to dental insurance coverage as provided by the Borough and more fully described in the Borough's Personnel Manual.

Every officer or employee of the Borough of Hopatcong now or hereafter employed shall be entitled to life and accidental death and dismemberment insurance as follows:

A. 
Every officer or employee of the Borough of Hopatcong not covered under a bargaining-unit agreement shall be entitled to sick leave as follows:
(1) 
Sick leave will be provided at a rate of 1 1/4 days for each full month of service on the first month of employment, but will not be earned for time spent by the employee on workers' compensation nor for any time spent on leave without pay. Sick leave will continue to accrue while an officer or employee is on leave with pay.

(2) 
Sick leave that is not used during a calendar year shall accumulate from year to year.
B. 
Payment for accumulated sick leave.
(1) 
Those officers and employees not covered by a bargaining-unit agreement shall receive compensation for accumulated sick leave upon retirement, provided that they meet the following criteria:
(a) 
Eligibility. The employee must have at least 25 years of continuous service to the Borough at time of retirement.
(b) 
The maximum amount of payment shall not exceed $10,000.
(c) 
Computation of payment shall be as follows:

First 100 days of accumulated sick leave: 25% of average daily pay.
[2] 
Next 100 days of accumulated sick leave: 30% of average daily pay.
[3] 
All over 200 days of accumulated sick leave: 42% of average daily pay.
(d) 
In the event of the death of an officer or employee who meets the twenty-five-year continuous service criteria, payment shall be made to the estate of the officer or employee.
(e) 
Payment may be made in up to three annual installments at the option of the Mayor and Council.
(f) 
Average daily pay shall be determined by dividing the annual salary by the number of hours of work on an annual basis.
(g) 
The employee provides the Borough with 180 days' written notice of retirement. If extenuating circumstances beyond the control of the employee are deemed to warrant an exception to said notice, this requirement may be waived by resolution of the Mayor and Council.

(2) 
Those employees covered under a bargaining-unit agreement shall receive sick-leave benefits as prescribed in the agreement.

A certain agreement between the Borough of Hopatcong and the members of the Hopatcong Police Department represented by PBA Local 149, a copy of which is annexed hereto and incorporated herein by reference (a copy of which shall remain on file in the office of the Clerk of the Borough of Hopatcong), is hereby ratified, confirmed and approved.
B. 
The Mayor and Clerk are hereby authorized to execute said agreement on behalf of the Borough of Hopatcong.
C.

(2) 
Step movements shall be made by all officers not already in top grade on January 1 of each year. All Officers hired after July 1, 1987 will receive the step movement on their anniversary date until the Officer reaches top grade.

The Captains and Lieutenants will be eligible for overtime compensation at 1 1/2 times their hourly rate of pay.

A. 
A full-time officer or full-time employee of the Borough of Hopatcong who sustains a personal injury by accident arising out of and in the course of his or her employment for the Borough of Hopatcong, which results in said full-time officer or employee becoming temporarily disabled as same is defined by the Workmen's Compensation Laws of the State of New Jersey, which entitles said full-time officer or full-time employee to receive temporary disability benefits under the Workmen's Compensation Laws of the State of New Jersey, shall then be entitled to receive weekly supplemental benefits in an amount equal to his or her gross salary less his or her regular social security, pension and federal and state income tax withholding deductions and the amount of temporary disability benefits received under the Workmen's Compensation Laws of the State of New Jersey.
B. 
A full-time officer or a full-time employee who qualifies for temporary disability benefits under the Workmen's Compensation Laws of the State of New Jersey but does not receive same during the first seven days of his or her disability, due to the seven-day waiting period prescribed by N.J.S.A. 34:15-14, shall be entitled to receive his gross salary less his or her regular social security, pension and federal and state income tax withholding deductions during this first seven-day period of disability; provided, however, that in the event his or her temporary disability extends beyond said seven-day waiting period, any workmen's compensation temporary disability benefits received for this first seven-day period shall be reimbursed to the Borough of Hopatcong.
C. 
The supplemental temporary disability benefits provided for herein shall not exceed a period of six months for any disability occurring out of the same accident.
D. 
This section shall take effect retroactive to April 1, 1975.

Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the Defined Contribution Retirement Program: Municipal Administrator; Recreation Activities Coordinator; Zoning Officer; Water/Sewer Operator; and Municipal Court Judge.
B. 
Pursuant to N.J.S.A. 43:15C-2, the following positions are exempt from Defined Contribution Retirement Program membership and shall be enrolled in the Public Employees Retirement System: Certified Health Officer; Tax Collector; Chief Financial Officer; Construction Code Official; Qualified Purchasing Agent; Tax Assessor; Registered Municipal Clerk; Licensed Uniform Subcode Inspector; Principal Public Works Manager; and Municipal Court Administrator.
