Pursuant to § 1 of the Act of December 12, 1979, P.L.
503, No. 108,[1] there is hereby established the Borough of Souderton Educational
Service Agency.

The Borough of Souderton Educational Service Agency shall have
as its purpose the employment and supervision of school-crossing guards
and part-time police officers when working at school activities.
The Borough of Souderton Educational Service Agency shall consist
of three persons and shall be those members of the Borough Council
who chair the Police Committee, Finance Committee and Administrative
Committee.
The members of the Educational Service Agency shall serve for
a term of three years, coinciding with the calendar year.
Vacancies on the Educational Service Agency shall be filled
by appointment by Borough Council for the unexpired term of the member
being replaced.
The members of the Educational Service Agency shall serve without
compensation. They may, however, receive reimbursement for ordinary
and necessary expenses incurred in the performance of their duties.
The Borough of Souderton Educational Service Agency shall have
the duty and authority to:

From time to time employ, discharge and fix the compensation of school-crossing
guards and part-time police officers when working at school activities.
B.
Exercise supervision and control over school-crossing guards and
part-time police officers at school activities by establishing and
enforcing rules and regulations for their work and conduct, establishing
work schedules and designating locations where the duties of the crossing
guards and part-time police officers are to be performed, and otherwise
exercising supervision and control. The Educational Service Agency
may, from time to time, delegate any or all of the above duties to
other officials of the Borough of Souderton.
The Borough shall establish a separate department for payroll
purposes entitled "Educational Service Agency" from which shall be
disbursed funds that the Borough is required to pay as compensation
to crossing guards and part-time police officers employed by the Educational
Service Agency and all other expenditures incurred in connection therewith.
The Borough of Souderton Educational Service Agency is recognized
by the Borough Council of the Borough of Souderton as the Borough's
agency for management and control of school-crossing guards and part-time
police officers working at school activities.
