The Uniform Fire Safety Act (P.L. 1983, c. 383) was enacted for the purpose of establishing a system for
the enforcement of minimum firesafety standards throughout the State
of New Jersey; and the Uniform Fire Safety Act authorizes municipalities
to provide for local enforcement and to establish local enforcement
agencies for that purpose; and it is in the best interest of the Township
of Mine Hill to have the Uniform Fire Safety Act enforced locally;
and the Fire Department of the Township of Mine Hill has agreed to
the plan which is set forth herein for the administration and enforcement
of the Uniform Fire Safety Code.

Pursuant to Section 11 of the Uniform Fire Safety Act (P.L.
1983, c. 383), the New Jersey Uniform Fire Code (N.J.A.C. 5:70-1 et seq.)
shall be locally enforced in the Township of Mine Hill.

The local enforcing agency shall be the Township of Mine Hill.

A. Within the established boundaries of the Township of Mine Hill, the
local enforcing agency shall enforce the Uniform Fire Safety Code
in all buildings, structures, and premises other than one- and two-unit
owner-occupied buildings used exclusively for dwelling purposes and
buildings, structures, and premises owned or operated by the federal
government, interstate agencies or the state.
B. The local enforcing agency shall faithfully comply with all the pertinent
requirements of the Uniform Fire Safety Code.
C. Technical amendments to code. The following amendments to the Uniform
Fire Safety Code are hereby made:

(1) Code Section 308.1.4 Open flame cooking devices and outdoor
fireplaces. Charcoal burners, other open flame cooking devices
and outdoor fireplaces shall not be operated or stored on combustible
balconies or decks or within 15 feet of combustible construction.
Exceptions:
1. One and two-family dwellings.
2. When buildings, balconies and decks are protected by an automatic
sprinkler system.
3. LP-gas cooking devices having LP-gas container with a water
capacity not greater than 2.5 pounds (nominal 1 pound (0.454 kg) LP-gas
capacity).
(2) Code Section 308.1.4.1 Liquified-petroleum-gas-fueled cooking
devices. LP-gas burners having an LP-gas container with a water
capacity greater than 2.5 pounds [nominal 1 pound (0.454 kg) LP-gas
capacity] shall not be located on combustible balconies or within
15 feet (3048 mm) of combustible construction.
Portable LP-gas cooking equipment such as barbecue grills and
outdoor fireplaces shall not be stored or used:
1. On any porch, balcony or any other portion of a building;
2. Within any room or space of a building;
3. Within 15 feet of any combustible construction;
4. Within 15 feet, vertically or horizontally, of an opening
in any wall; or
5. Under any building overhang.
Exception: Detached owner-occupied one- and two-family dwellings.
The local enforcing agency established by §
252-3 shall carry out the periodic inspections of life-hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs of the State of New Jersey.

The Fire Marshal shall be responsible for inspections and enforcement
under the Uniform Fire Safety Code and shall be within the Division
of Fire Protection in the Department of Public Safety.

A. Appointment and qualifications of the Fire Marshal. The Fire Marshal
shall be certified by the state and appointed by the Mayor with the
advice and consent of members of the Council.
B. Appointment and qualifications of inspectors and other employees.
Inspectors and other employees of the enforcing agency may be appointed
by the Mayor with the advice and consent of members of the Council
upon recommendation of the Fire Marshal. All life-hazard use inspectors
shall be certified by the state.
C. Term of office. The Fire Marshal shall serve for a term of one year
and until his/her successor shall be duly qualified for the office.
Any vacancy shall be filled for the unexpired term.
D. Removal from office. The Fire Marshal, inspectors and other employees
of the agency shall be subject to removal by the governing body for
just cause. Before removal from office, all persons shall be afforded
an opportunity to be heard by the governing body or a hearing officer
designated by the same.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement
agency shall have the right of appeal to the Morris County Construction
Board of Appeals.
The permit fees established by the Uniform Fire Code shall be as set forth in Chapter
235, Fees.

Non-life hazards shall be inspected and shall pay an annual inspection fee as set forth in Chapter
235, Fees.
