Regulations and controls for permitted land uses or activities, or uses or activities requiring a special permit or having special conditions applied thereto, are set forth in Schedule I. Regulations for lot size, yards, coverage and similar bulk requirements for each zoning district are set forth in § 308-43, Schedule II. Both of said schedules, and any amendments thereto, are hereby adopted and made a part of this chapter.[1]

A land use or activity which is not specifically set forth in § 308-42, Schedule I, is not permitted in the Town of Marion except that a use or activity which, in the opinion of the Zoning Board of Appeals, is similar in nature, scale and anticipated impact to a permitted use or activity may be permitted by special permit authorized by the Board of Appeals if application therefor has been made. [See §§ 308-25D, 308-32B(6)(c) and 308-46.]
