The Zoning Board of Appeals consisting of seven
members, as constituted and empowered under § 267 of Article
16 of the Town Law, on the effective date of this chapter shall be
continued. Vacancies occurring in such Board shall be filled in accordance
with the Town Law. The Zoning Board of Appeals shall have all the
powers and perform all the duties prescribed by statute and by this
chapter.
A. Definitions. As used in this article:
AREA VARIANCE
The authorization by the Zoning Board of Appeals for the
use of land in a manner which is not allowed by the dimensional or
physical requirements of the applicable zoning regulations.
USE VARIANCE
The authorization by the Zoning Board of Appeals for the
use of land for a purpose which is otherwise not allowed or is prohibited
by the applicable zoning regulations.
