Wherever a space is marked off on any street for the parking
of an individual vehicle, every vehicle parked there shall be parked
wholly within the lines bounding that space, and it shall be a violation
of this article for any person to park a vehicle or allow it to remain
parked otherwise.

On all streets where angle parking is required, every vehicle parked
at the angle shall be parked with its front nearest the curb.
A.Â
Findings and purpose. The City of Lock Haven finds that:
(1)Â
Certain residential areas in the City are subjected to commuter vehicle
parking, therefore depriving the residents of those areas of spaces
in which to park their own vehicles.
(2)Â
Those residential streets are also subjected to a high degree of
commuter traffic which substantially reduces the quality of the ambient
air level.
(3)Â
The establishment of a parking permit program for certain affected
areas should facilitate efficient movement of traffic by providing
for parking preference during certain hours of the day and days of
the week. Therefore, the City considers it to be in the interest of
the people of the City to provide for the establishment of a residential
permit parking program to insure primary access to available parking
spaces by neighborhood residents and also to provide a cleaner ambient
air level.
B.Â
COMMUTER VEHICLE
PROPRIETOR
RESIDENT
RESIDENTIAL AREA
Definitions. For the purpose of this section, words and terms listed
in this subsection, as follows, shall have the following meanings:
A motor vehicle parked in a residential area by a person
not a resident of that residential area.
A person who owns or leases real estate within a residential
area of which he is not a resident, but who owns or manages a business
enterprise or professional office maintained at that address. For
the purpose of this section, a proprietor shall be entitled to one
parking permit for that business or professional office address.
A person who owns or leases real property within a residential
area and who maintains either a voting residence or bona fide occupancy,
or both, at that address.
A contiguous area containing public highways or parts of
public highways primarily abutted by residential property or residential
and non-business property (such as schools, parks, places of worship,
hospitals and nursing homes).
C.Â
Criteria. The residential areas designated in Subsection D of this section are those deemed impacted and hence eligible for residential parking on the basis of the following criteria:
(1)Â
During any period between the hours of 7:00 a.m. and 6:30 p.m., Monday
through Saturday, except legal holidays, the number of vehicles parked
(or standing), legally or illegally, on the streets in the area is
equal to 70% or more of the legal, on-street parking capacity of the
area. For the purpose of this criterion, a legal parking space shall
be 20 linear feet.
(2)Â
During the same period as specified in Subsection C(1), 10% or more of the vehicles parked (or standing) on the streets in the area are not registered in the name of a person residing in the area. For the purpose of this criterion, the latest available information from the Pennsylvania Department of Transportation regarding registration of motor vehicles shall be used.
(3)Â
Provided: in determining that a specific area identified as impacted
and eligible for residential permit parking is designated as a residential
permit parking area, the following factors are taken into consideration:
(a)Â
The local and metropolitan needs with respect to clean air and
environment.
(b)Â
The possibility of a reduction in total vehicle miles driven
in the City.
(c)Â
The likelihood of alleviating traffic congestion, illegal parking
and related health and safety hazards.
(d)Â
The proximity of public transportation to the residential area.
(e)Â
The desire and need of the residents for residential permit
parking and their willingness to bear the administrative costs in
connection with it.
(f)Â
The need for parking in excess of the residential permit parking
program in proximity to establishments located in the residential
permit parking area and used by the general public for religious,
health or educational purposes.
D.Â
Designation of residential permit parking areas.
E.Â
Application for permit. Application for a residential parking permit
shall be made to the Chief of Police by the person desiring the permit,
who shall be only the owner or the driver of a motor vehicle who resides
on or is a proprietor of property immediately adjacent to a street
or other location within a residential parking permit area. A separate
application shall be required for each motor vehicle, and each application
shall be accompanied by a permit fee, in an amount as established
by resolution of the City Council, which shall be for the use of the
City, to be applied to the cost of administering the residential permit
parking program. Each application shall contain the following information:
the name of the owner or the driver, as the case may be, of the motor
vehicle; the address of the resident or the proprietor, as the case
may be; the make, model and registration number of the motor vehicle;
and the driver number as taken from the applicant's current driver's
license. At the discretion of the Chief of Police, the applicant shall
be required, at the time of making application, to present his driver's
license and the vehicle registration card.
F.Â
Issuance of permit. Upon receipt of the application and the permit
fee, and determination by him that the information upon the application
shows that the applicant is entitled to a residential parking permit,
the Chief of Police shall issue to the applicant a residential parking
permit, which shall be valid for the remainder of the calendar year.
The permit shall display the serial and registration numbers of the
motor vehicles, the residential parking area number and the expiration
date. The permit shall be renewable annually before the expiration
date, upon making application for renewal and payment of the permit
fee. It shall be unlawful and a violation of this section for any
person to display other than the current and valid permit while standing
or parking in a residential permit parking area at any time when those
permits are to be displayed.
G.Â
Temporary and exemption parking permits. Temporary parking permits
may be issued by the Chief of Police, upon payment of a fee in an
amount as established by resolution of the City Council, to bona fide
visitors of residents of a designated residential permit parking area,
and exemption parking permits may be issued, without payment of a
fee, to handicapped persons.
H.Â
Responsibility of permit holder.
(1)Â
Notwithstanding any provision of this section to the contrary, the
holder of a residential parking permit shall be permitted to stand
or park a motor vehicle operated by him in any designated residential
parking area during those times when parking of motor vehicles is
permitted in that area. While a vehicle for which a residential parking
permit has been issued is so parked, that permit shall be displayed
so as to be clearly visible through the windshield of the vehicle.
A residential parking permit shall not guarantee or reserve to the
holder a parking space within a designated residential permit parking
area.
(2)Â
A residential parking permit shall not authorize its holder to stand
or park a motor vehicle in any place where or at any time when stopping,
standing or parking of motor vehicles is prohibited or set aside for
other specified types of vehicles, nor shall the permit exempt its
holder from the observance of any traffic or parking regulation other
than residential permit parking regulation or restriction.
(3)Â
No person other than the permit holder whose name appears on the
permit shall use a residential parking permit or display it on a vehicle
operated; any such use or display by a person other than the permit
holder shall constitute a violation of this section by the permit
holder and by the person who so used or displayed the parking permit.
(4)Â
It shall constitute a violation of this section for any person falsely
to represent himself as eligible for a residential parking permit
or to furnish false information in an application to the Chief of
Police in order to obtain a residential parking permit.
I.Â
Revocation of permits. The Chief of Police shall have authority to
revoke the residential parking permit of any permit holder found to
be in violation of any provision of this section. Upon written notification
to the permit holder of the revocation, the permit holder shall surrender
the permit to the Chief of Police. Failure to do so, when so requested,
shall constitute a violation of this section. Provided, any person
receiving such a notice may, within 10 days after the date of the
notice, appeal to the City Council for a hearing on the revocation,
and the decision of the City Council shall be final.
It shall be unlawful for any person to park a vehicle or to
allow the same to remain parked, at any time between [_____] and [_____]
on any of the following portions of the highways of the City on the
days hereby respectively designated for street sweeping purposes:

A.Â
Any person who violates any provision of this article shall, upon
conviction, be sentenced to pay a fine of not more than $30 and costs.
Provided, it shall be the duty of the police officers and of parking
enforcement personnel of the City to report to the appropriate official
all violations of any provision of this article indicating, in each
case, the section violated; the license number of the vehicle involved
in the violation; the location where the violation took place; and
any other facts that might be necessary in order to secure a clear
understanding of the circumstances attending the violation. The police
officer or other person making the report shall also attach to or
place upon every such vehicle a notice stating that the vehicle was
parked in violation of this article. The notice shall contain instructions
to the owner or driver of the vehicle that he may pay the specified
fine by placing the amount in the envelope provided and depositing
it in any of the Yellow Traf-O-Teria courtesy boxes or by paying at
City Hall between 8:00 a.m. and 5:00 p.m., Monday through Friday (except
holidays) or by placing a stamp on the reverse side and mailing using
address indicated.

Any violation of the special purpose parking zones designated as handicapped parking in § 380-32 shall be subject to a fine of $50, which will increase by $10 if not paid within five calendar days of notice of violation, and by an additional $5 if not paid within 10 calendar days thereafter.

The boundary limits of the City of Lock Haven are hereby established
as a zone in which motor vehicles may remain standing without lights,
and all highways within such boundary limits are hereby designated
as highways where motor vehicles may remain standing without lights.
The City of Lock Haven has determined that there are certain
intersections where, due to a particular safety hazard, it is necessary
to extend the area of prohibited parking beyond that specified under
the Pennsylvania Vehicle Code, Title 75, Pa.C.S.A. These areas shall
be clearly marked by roadway markings and/or appropriate signs located

BOOT, BOOTING, or BOOTED
UNSETTLED CITATIONS
UNSETTLED PARKING VIOLATIONS
Definitions. For the purpose of this section, the following terms
and words are defined as follows:
The terms "boot," "wheeled vehicle immobilizer" and "immobilizing
device" shall be synonymous. The act of immobilizing a motor vehicle
in such a manner as to prevent its operation while an immobilization
device is employed, wherein damage to such vehicle will not result,
unless the vehicle is moved while such device is in place or such
means are employed.
Citations/summons for unpaid parking violations which have
been issued by a court of competent jurisdiction in which either no
response has been made to the summons, or for which a warrant has
been issued for the operator and/or registered owner of the vehicle,
including adjudicated citations for which the fines and costs imposed
remain unpaid.
Violations of the parking, standing or stopping regulations
of the City of Lock Haven or the Pennsylvania Motor Vehicle Code,
which are outstanding and unpaid for over 30 days from the date of
issuance.
B.Â
Boot installation. A motor vehicle found to be parked within the
City of Lock Haven upon any public ground, may, by or under direction
of the Manager or his designee, be booted if there are 10 or more
unsettled parking violations or two or more unsettled citations or
one or more arrest warrants pending against the owner of the motor
vehicle as the result of parking violations previously issued and
pending.

Notice of booting. Upon installation of the boot upon such motor
vehicle, the Officer shall place or cause to be placed upon the vehicle
in a conspicuous manner, notice sufficient to warn any individual
that the vehicle has been immobilized, and that any attempt to move
the vehicle may result in damage to the vehicle. The notice shall
outline the procedure for obtaining removal of the boot. As soon as
practicable, the Officer shall, upon request, provide the owner of
the booted vehicle with documentation of all prior unsettled parking
violations and/or unsettled citations for which such vehicle was booted,
and shall take all other appropriate action with respect to any outstanding
warrant. Within 24 hours, excluding weekends and holidays, the Chief
of Police shall cause notice to be mailed to the registered owner
of said vehicle, notifying the owner that the vehicle has been immobilized
(booted), the reason and location of the immobilization and the procedure
for obtaining release of the vehicle.
D.Â
Removal of boot. The owner of a vehicle that has been immobilized
(booted), or other authorized person acting on behalf of the owner,
shall be permitted to secure the release of the vehicle when the following
criteria have been met:
(1)Â
Deposit the required collateral for his/her appearance before the
Magisterial District Judge to answer for each unsettled citation;
or pay the amount of the fine and court costs in full for each unsettled
citation. If there are any unsettled parking violations, pay the amount
of the five and costs in full for each unsettled parking violation;
and

Immobilization hearing. The owner or other authorized person of a
vehicle which has been immobilized (booted), shall have the right
to a post-immobilization hearing, limited to a determination of the
validity of the immobilization (booting). Such hearing must be requested
within 10 days after the vehicle is booted and shall be conducted
by a hearing officer appointed by the City Manager. The hearing shall
be held during normal business hours within two business days of the
request. The post-immobilization hearing will not be determinative
of, or adjudicate the merits of, any citation or parking violation
issued relative to the immobilization of any vehicle and shall be
limited solely to whether or not the vehicle was properly subject
to immobilization (booting) with respect to the provisions of this
section.
F.Â
Towing and storage of vehicles. Except when the provisions of Subsection D have been met and all fines, costs and fees have been satisfied, the immobilization device (boot) shall remain in place for 72 hours. If such provisions have not been made to satisfy all fines, costs and fees within the seventy-two-hour period, the vehicle shall be subject to being towed to an approved secure facility and remain impounded until such fines, costs and fees are paid. If the immobilization (booting) occurs while the vehicle is parked in violation of any provision of law or any City ordinance providing for the immediate removal of a vehicle, or if the immobilization (boot) device appears to have been tampered with, the vehicle shall be subject to immediate removal by towing and impounded until all fines, costs, and fees, together with all costs of towing and storage, have been satisfied. All towing and storage fees as specified shall be paid directly in the towing and storage firms prior to the release of said vehicle to the owner or other authorized person on the owner's behalf. Any vehicle unclaimed after 45 days of the date towed shall be deemed abandoned and subject to disposal in the manner authorized by Pennsylvania statute.
G.Â
Booting fee. The owner of the immobilized (booted) vehicle shall
be subject to a fee of $75 for such immobilization and subsequent
removal.
H.Â
Tampering with boot prohibited. Any person who shall tamper with,
remove or attempt to remove any device used to immobilize a motor
vehicle that has been booted pursuant to this section, or who shall
move or attempt to move the vehicle immobilized (booted) before release
of the vehicle has been officially secured, shall be guilty of a summary
offense and, upon conviction thereof, shall be fined not less than
$100 nor more than $600, together with the cost of prosecution and
the cost to replace the boot, or be imprisoned for not more than 30
days, or both.
I.Â
Implementation and enforcement. It shall be the duty of the Officers
of the Lock Haven City Police Department, or other designated employees
of the City, acting in accordance with the instructions of the City
Manager or his designee, to enforce the provisions of this section.
J.Â
Right to hearing not waived. Nothing in this section shall be constructed
to deprive any person of their Constitutional right to a hearing or
trial as provided by law, relating to the violations for which parking
violation notices or citations have been issued.

A.Â
Any vehicle parked either on or adjacent to a roadway, street, or
alley shall be parked facing in the direction of travel on the side
of the center line on which the vehicle is parked.
B.Â
Any vehicle parked on a roadway must be parked so that the curbside
tires are within 12 inches of the curb.
