Acts and activities prohibited on any land on the oceanfront or bayfront, all public street ends on the oceanfront or bayfront and on all beaches in Long Beach Township:
A. To throw, bat or catch a baseball, football, basketball, softball, rubber ball, beach ball, Frisbee or any other object or to fly kites or any other object in the protected beach areas where bathing is supervised. No other activity or action shall be permitted which will endanger or be likely to endanger the health, safety or welfare of others or oneself.
B. To swim or bathe beyond a safe depth in the ocean in the supervised area, as indicated by yellow flags, determined or regulated by the Township lifeguards.
C. To use any inflatable raft, innertube, water wings, skimboard or any floating or inflated object of any kind or description in guarded areas denoted by yellow flags on ocean beaches of the Township, except as indicated, determined or regulated by the Township lifeguards.
D. To throw, place, deposit or leave any bottles, glass, crockery, sharp or pointed article or thing, paper, refuse or debris of any kind in the areas except in the proper receptacles provided therefor on the beach or at the street ends. No trash cans are to be taken from the streets and placed on the beach by unauthorized persons.
E. To fail to immediately obey all orders, direction, whistles or other signals used by the Township lifeguards and police.
F. To sleep on the beach within the areas defined during any time between 12:00 midnight and 6:00 a.m.
G. To change clothes, dress, undress or otherwise to disrobe, except outer wraps.
H. To picnic, which shall mean the carrying of or otherwise transporting any box, basket, bag, tub or other receptacle in which there is contained food or beverages, or both, and the consumption of the food or beverages, or both, within the areas described. The possession of nonalcoholic beverages for consumption not exceeding one quart per person shall not be construed as picnicking on the protected bathing areas.
I. To ride or walk horses on the beach.
J. To run on the beach within the guarded areas supervised by the Township lifeguards and designated as protected bathing areas.
K. To launch or land jet skis in the ocean or bay beaches of the Township. It is further prohibited to launch or land any type of boat within a guarded beach area. Anyone launching or landing any type of boat at an ocean or bay beach does so at his or her own risk.
L. To operate, ride or use a skateboard, or park or store a boat, hobie-cat or boat trailer in the Township-owned ocean- or bayfront parks.
M. To windsurf in any Township of Long Beach areas other than the Bayview Park windsurfing area.
N. The installation or placement of any device of any sort, kind or description in the dune area as hereinbefore defined in §
51-3 other than protective works approved or undertaken by the Township, county, state or federal government or protective devices, including dune walkovers approved by the New Jersey DEP, installed pursuant to approval issued by the Long Beach Township Building Department.
O. Walking on, sitting on, or standing on or otherwise occupying the dune area as that term is defined in §
51-3 in the Code of Long Beach Township.
P. There shall be no feeding of wildlife.
Q. The erection of any tent, beach umbrella, sunshade or any other device of any sort, kind or description intended to shade people beneath it from the direct rays of the sun with the exception of collapsible monopole beach umbrellas which have a maximum diameter of the umbrella not exceeding eight feet and tents and other devices approved by the Long Beach Township Police Department for use by the holders of any permit issued pursuant to Chapter
131 of the Code of Long Beach Township.
R. The installation, erection, and/or placement of any beach umbrella between the hours of 7:00 p.m. and 9:00 a.m.
S. There shall be no beach fires of any type.
T. The use of any electronic smoking device, vaping, or aerosolizing or smoking, inhaling, exhaling, burning or carrying of any lighted cigarette, cigar, pipe, weed, plant, cannabis, or other combustible substance in any manner or in any form, including but not limited to tobacco, nicotine-based products, or similar products.
U. To place a table, or any object utilized as a table on the oceanfront or bayfront beaches.
V. There shall be no deliveries of food, beverages or refreshments of any kind to the oceanfront or bayfront beaches.
W. To sit, stand, walk, run or fish on any oceanfront rock jetty.
X. The setting up, installation, erection, and/or placement of any beach chairs, towels, or any other beach supplies, equipment, and/or accessories between the hours of 7:00 p.m. and 9:00 a.m. without the owner and/or end user of the aforesaid present. No unattended beach supplies, equipment, and/or accessories shall be placed on the beach during the aforesaid hours which has the effect of reserving public beach space for persons not present at the time of installation, erection, and/or placement to attend to and use such.
Y. To surf on any oceanfront beach, unless so designated by and between blue flags.
Z. Except as authorized by Article
III of this chapter, no vehicles or bicycles of any kind shall be permitted on the beach, including, but not limited to, motor vehicles, motorcycles, bicycles, electric and/or e-bikes, and scooters. The riding of bicycles, electric, and/or e-bikes on the beach shall be permitted between and including October 1 and May 14.
