A.
The exterior of the premises and all structures thereon shall be kept free of all nuisances and any hazards to the safety of occupants, pedestrians and other persons utilizing the premises, and free of insanitary conditions, and any of the foregoing shall be promptly removed and abated by the owner or operator in order to keep the premises free of hazards, which include but are not limited to the following: Brush, weeds, broken glass, stumps, roots, obnoxious growths, filth, garbage, trash, refuse and debris.
B.
Loose and overhanging objects and accumulations of ice and snow which, by reason of location above ground level, constitute a danger of falling on persons in the vicinity thereof, shall be removed.
C.
Vacant lots or lots containing untenanted buildings shall be kept free of brush, weeds, broken glass, tree stumps, roots, obnoxious growths, filth, garbage, trash, refuse, debris and abandoned vehicles. The owner or operator of said lot shall erect and maintain around the perimeter of such lot a chain link, picket or stockade fence of a height no less than 42 inches nor more than 54 inches or a barricade with steel beams of a height of approximately 36 inches extending approximately 48 inches below ground. All fences shall be kept in good repair. The fence or barrier shall not be equipped with or contain barbed wire, spikes or any similar device.
D.
Proposed ordinances for multi-family buildings of four units or more.
(1)
Property owners must provide an adequate number of receptacles to containerize solid waste ( garbage) and recycling bottles and cans). All garbage and recycling (bottles and cans) must be in receptacles (containerized).
(2)
Properties of six or units or more must provide 3 cubic feet dumpsters for solid waste (garbage) and recycling (bottles and cans).
(3)
Commingling or mixing solid waste (garbage) and recyclables (bottles, cans and cardboard) is prohibited.
(4)
Overflowing receptacles preventing lids from closing, solid waste (garbage) spilling from receptacles onto the ground, or more solid waste (garbage) or recycling (bottles and cans) in a receptacle than it can hold is prohibited.
(5)
All receptacles must have lids, and lids must completely close on receptacles.
(6)
Receptacles must be placed at the curb after 6:00 PM the evening prior to collection and shall not be put out the morning of the collection with consideration that collection times vary and are not mandated to start after 9:00 AM may start as early as 5: 00 AM).
(7)
Receptacles, solid waste (garbage), and recycling (bottles and cans) shall be stored in the rear of the property and not at the front or side of property.
(8)
When placed at the curb for collection, corrugated/ cardboard boxes and cartons shall be flattened and securely bundled/tied.
E.
Violations and penalties.
(2)
Plea negotiations shall not be set below the $750 minimum.
(3)
An additional separate $1,000 fine shall be imposed for violating an ordinance within one year of the date of a previous violation of the same ordinance and fined for the previous violation, shall be sentenced by a court to an additional fine as a repeat offender. The additional fine imposed by the court for a repeat offense shall not be less than the minimum or exceed the maximum fine fixed for a violation of the ordinance but shall be calculated separately from the imposed for the violation of the ordinance.
(4)
Any person convicted of the violation of any ordinance or in default of the payment of any fine imposed may be imprisoned in the county jail or place of detention provided by the municipality, for any term not exceeding 90 days, or be required to perform community service for a period not exceeding 90 days.
