[HISTORY: Adopted by the Municipal Council of the Township of Irvington 1-14-2003 by Ord. No. MC 3210 (Ch. 98, Art. II, § 98-52, of the 1981 Revised Code). Amendments noted where applicable.]
The purpose of this chapter is to set forth the Township of Irvington's fee schedule for obtaining copies of government records.
As used in this chapter, the following terms shall have the meanings indicated:
GOVERNMENT RECORD(S) or RECORD(S)
Any information subject to public inspection which is maintained by the Township of Irvington in written, audio, video, electronic or other form and as defined by the Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
SPECIAL SERVICE CHARGE
A charge, in addition to the actual cost of duplicating the government record(s), which shall reflect the expense associated with extensive use of Township information, technology or resources, or the extensive clerical or supervisory assistance by Township of Irvington personnel necessary to accommodate and as defined by the Open Public Records Act, N.J.S.A. 47:1A-5c and 47:1A-5d.
The fees for copies of government records shall be:
A. 
Photocopies of records shall be $0.05 per letter size page or smaller, and $0.07 per legal size page or larger.[1]

B. 
Maps.
(1) 
Maps that are 32 inches by 32 inches (zoning, historic preservation, elections, street, flood): $5 per sheet.
(2) 
Maps that are 24 inches by 36 inches (tax and other maps): $5 per sheet.
(3) 
Maps that are 11 inches by 17 inches (tax and other maps): $1.50 per sheet; and maps that are 18 inches by 30 inches (tax and other maps): $14.

(4) 
Maps that are 8.5 inches by 11 inches or 8.5 inches by 14 inches maps: Fees per page in accordance with Subsection A.
(5) 
Full set of Tax Maps (24 inches by 36 inches): $600.
(6) 
Full set of Tax Maps (11 inches by 17 inches): $120.
(7) 
Tax Map overlays: $20 per sheet.
(a) 
Individual print out of Tax Map overlay, including topographical information: $7 per acre.
(8) 
Topographical maps (24 inches by 36 inches): $7 per acre.
(9) 
Digital copies of Tax Map sheets.
(a) 
Digital copy of Tax Map sheet (3.5 inch floppy disk) file in DWG format: $50 per sheet.
(b) 
Digital copy of Tax Map sheet (CD) file in DWG format: $60 per sheet.
(c) 
Digital copy of Tax Map sheet (CD or 3.5 inch floppy disk) in TIFF format: $25 per sheet file.
(d) 
Digital copy of Tax Map sheet, including topographical information: add $7 per acre.
(e) 
Additional charge for printout (24 inches by 36 inches): $5 per sheet.
C. 
Engineering standards, details and design criteria:
(1) 
Hard copy: $50.
(2) 
Digital copy (CD): $50.
D. 
Historic Preservation Commission booklet: $5.
E. 
Parks and open space booklet: $3.
F. 
Township directory: $4.
G. 
Land Use Code book: $110, plus supplements.[2]

N. 
Postage. Postage costs will be added to fees for copies of records requested to be mailed and will be determined at the time of the request.
O. 
Accident reports (with respect to emailed or faxed reports): If copies of reports are requested other than in person, an additional fee of up to $5 may be added to cover the administrative costs of the report.

A. 
A special service charge may be applied by the custodian of records or his/her designee in the following circumstances:
(1) 
When the nature, format, manner of collation or volume of a government record embodied in the form of printed matter to be inspected, examined or copied is such that the record cannot be reproduced by ordinary copying equipment in ordinary business size or involves an extraordinary expenditure of time and effort to accommodate the request; or
(2) 
When the request is for a government record in a medium not routinely developed or maintained by the Township; or
(3) 
When a request for a government record requires a substantial amount of manipulation or programming of information technology by the Township and the cost of such manipulation or programming is not otherwise included in the fee or fees listed in § 462-3A.
B. 
The special service charge rate for supervisory, programming and/or clerical services shall be charged per hour and as follows:
(1) 
The hourly rate shall be the hourly wage of the employee conducting the supervisory, programming and/or clerical services as set by the Township by resolution and/or collective bargaining agreement(s) by 26 (weeks) and then dividing that biweekly pay by the number of hours worked in a biweekly period.
