No building permit shall be issued for any of the uses listed
below unless a site plan shall have first been approved by the Planning
Board or Zoning Board of Adjustment; provided, however, that this
requirement shall not apply when the proposed development involves
only a change in the use of any building or other structure or use
of land for which approval is required and no new construction or
structural alteration or enlargement of any existing building or other
structure is contemplated:
A. Any use other than a one- or two-family dwelling.
D. Parking areas for four or more vehicles.
In connection with the following classes of site plans, the Planning Board or Zoning Board of Adjustment shall hold a public hearing in accordance with the provisions of Chapter
365, Land Use Procedures, of the Code of the Township of Irvington, New Jersey:
A. Any site plan requiring a variance.
B. Any site plan which includes an application for a conditional use.
C. Any site plan which includes an application for a subdivision.
D. Any development which the Planning Board or Zoning Board of Adjustment
determines will have a significant impact upon the surrounding properties,
the neighborhood or the Town as a whole.
The Planning Board shall grant final approval if the detailed
drawings, specifications and estimates conform to the standards established
by this chapter, and provided further that the conditions of preliminary
approval have been met.
