The following words or phrases, unless the context clearly indicates
otherwise, shall have the meaning ascribed to them in this section:
OPEN
When used in connection with a container, shall mean any
container which has been perforated, in the case of a can or similar
container, or a container on which the cap has been removed.

Except as may be permitted by the City upon the filing of a
request for a permit, it shall be unlawful, within the City of Lock
Haven, for any person to drink alcoholic beverages upon any public
street, public sidewalk, public municipal parking lot, private parking
lot open to public use or public park, or to possess an open container
in the same. The City's authority to grant exceptions to the
requirements of this chapter limited by all applicable statutory or
regulatory provisions of the commonwealth.

It shall be unlawful, within the City of Lock Haven, for any
person to have in a vehicle operated or parked under such person's
control any open container containing alcoholic beverages upon any
public street, public sidewalk, public municipal parking lot, private
parking lot open to public use or public park, or to drink liquor
alcoholic beverages therein.

Any person who shall violate the provisions of this chapter
shall, upon conviction thereof, be sentenced to pay a fine not to
exceed $600 plus costs and, in default of payment of such fine and
costs, to undergo imprisonment for not more than 30 days.

A permit application for exceptions for the public consumption
of alcohol on any street, sidewalk, municipal parking lot, private
parking lot open to public use or public park must be filed with the
City Manager or designee and accompanied by the fee set from time
to time by resolution of Council. All permits must be approved by
City Council and will only become valid when accompanied by a special
occasion permit or off-premises catering permit issued to the applicant
by the Pennsylvania Liquor Control Board.
