A certain document, three copies of which are on file in the office of the Borough Manager of the Borough of Oakmont, County of Allegheny, Commonwealth of Pennsylvania, being marked and designed as International Fire Code, 2012 edition, as from time to time amended, as published by the International Code Council, Inc., be and is hereby adopted as the Fire Code of the Borough of Oakmont; regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the Borough Manager are hereby referred to, adopted, and made a part hereof, as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in § 103-2 of this chapter.
The following sections of the International Fire Code, 2012 edition, are hereby revised:
A. 
In Section 101.1, insert "Borough of Oakmont."
B. 
In Section 103 Department of Fire Prevention, delete the reference to "Department of Fire Prevention" and replace the deleted reference with a reference to "Chief Building and Fire Code Official."
C. 
Section 103.1 General is hereby amended to read as follows:
"The official in charge of implementation, administration and enforcement of the provisions of this code shall be the Chief Building and Fire Code Official (hereinafter, "Fire Code Official"). The Fire Code Official may be an individual or a corporation or other organization providing International Fire Code enforcement services. The provisions of this code may also be enforced by any other person or entity designated by the Borough of Oakmont by resolution."
D. 
Section 108.1 Board of Appeals established is hereby amended to read as follows:
"Any person aggrieved by a decision of the Fire Code Official or a notice or order issued under this code shall have the right to appeal, provided that a written application for appeal is filed within 20 days after the date of the decision, notice or order appealed from, to the Borough of Oakmont Uniform Construction Code Board of Appeals ("Board") which Board shall have jurisdiction to hear and rule on appeals filed hereunder. Such written appeal shall state the grounds for the appeal and be accompanied by the required appeal fee as set by resolution in the Borough of Oakmont Schedule of Fees. The appeal shall be processed and heard in compliance with the Local Agency Law and the procedural requirements of the Borough of Oakmont Uniform Construction Code Board of Appeals Rules of Procedure and Operation, provided, further, that any substantive requirements of such Rules of Procedure and Operation applicable only to appeals under the Uniform Construction Code shall not apply to appeals under the International Fire Code."
E. 
Section 108.3 Qualifications is hereby deleted.
F. 
Section 109.4 Violation penalties is hereby amended to read as follows:
"Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the Fire Code Official, or of a permit or certificate used under provisions of this code, shall be guilty of a summary offense, punishable by a fine of not more than $1,000 or by imprisonment not exceeding 30 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense."
G. 
Section 111.4 Failure to comply is hereby amended to read as follows:
"Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not more than $600.
Nothing in this chapter or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in § 103-5 of this chapter.
In any case of conflict between this chapter and the Uniform Construction Code (UCC) of the Commonwealth of Pennsylvania, Act 45 of 1999, 35 P.S. §§ 7210.101 to 7210.1103, as amended from time to time, the regulations and provisions of the UCC shall prevail.
All ordinances or resolutions or parts thereof conflicting with the provisions of this chapter are hereby repealed to the extent of such conflict, with the exception of Ordinance No. O25-2004.
