The purpose of this article is to protect the health, welfare
and safety of the public by providing a mechanism for the temporary
suspension of the other provisions of this chapter in the event of
public need, such as to facilitate snow removal, pave public streets
or parking areas, remove trees, or conduct public events.
The provisions of this article shall be used only when an authorized
representative of the Village of Round Lake declares a temporary parking
suspension.
A. The following individuals shall have the right to declare a temporary
parking suspension: the Village Mayor and the Village Highway Superintendant.
B. A temporary parking suspension may be declared when a person listed in § 168-21(A) determines that the purpose of this article as set forth in §
168-20 justifies such declaration.
C. Parking otherwise permitted under this chapter may be suspended or
modified when a temporary parking suspension has been declared and
the person making the declaration posts or causes to be posted a notice
of such declaration at two locations in the Village Hall (e.g., bulletin
board, door, window). Such notices shall describe the reason for the
temporary parking suspension (e.g., "To pave Burlington Avenue on
Saturday") and describe the manner and extent to which parking otherwise
allowed is restricted or prohibited in sufficient detail to put the
reader on notice of the same; and at least one of the following:
(1) Signs are placed in proximity to the affected parking areas (on-street
or off-street) with sufficient information to put the reader of the
sign on notice of the parking restriction or prohibition; or
(2) A memorandum is placed under the windshield-wiper of a vehicle parked
in an area affected by the temporary parking suspension with sufficient
information to put the reader of the memorandum on notice of the parking
restriction or prohibition; or
(3) The owner or operator of the vehicle is given verbal notice by a
Village representative in person or by telephone with sufficient information
to put the person on notice of the parking restriction or prohibition;
or
(4) A letter or e-mail is sent to the owner or operator of the vehicle
containing sufficient information to put the recipient on notice of
the parking restriction or prohibition at such person's last known
address as determined by Village tax records.

D. The notice period provided shall be reasonable under the circumstances,
except that at least three days' notice shall be provided when the
event for which the temporary parking suspension is declared has been
known to the Village at least a week prior to the event, and except
that notice by mail requires at least five calendar days. If the emergency
is obvious, such as fire, heavy snowfall or other visible causes,
which to a reasonably prudent person would indicate the existence
of an emergency, no notice shall be required.

Violation of this article is punishable as set forth in §
168-6. In addition to the fines provided therein, any vehicle parked in violation of this article may be towed or removed at the owner's expense as set forth in §
168-5.
