Article I Building Code Adoptions and Revisions

Section 500.010 Building Code.

A. A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Salem, Missouri, being marked and designated as the International Building Code, 2012 Edition, including Appendix Chapters C, F, H, I, and K, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Salem, in the State of Missouri, for regulating and governing the conditions and maintenance of all property, buildings and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Building Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

B. The following sections are hereby revised:

1. Section 101.1. Insert: City of Salem, Missouri, in place of (Name of Jurisdiction).

2. Section 105.1.1 and 105.1.2. Delete.

3. Section 105.2.

Subsection 2: Delete "7 feet" and replace with "3 feet."

Subsection 4: Delete.

Subsection 6: Delete.

Subsection 9: Delete and replace with "Prefabricated swimming pools accessory to a Group R-3 occupancy that are installed entirely above ground."

4. Section 107.1. Delete a portion of the paragraph limited to the following statement "where required by the statutes of the jurisdiction in which the project is to be constructed" and replace with "when required by the building inspector."

5. Section 110.3.7. Shall be amended to include "Where required by the Building Official" at the beginning of the Section.

6. Section 113. Delete the entire provision and replace with the following:

All appeals of orders, decisions or determinations made by the Building Official relative to the application of this code, all appeals shall be heard and governed by the provisions of Section 520.960 of this Code.

7. Section 1612.3. Insert City of Salem, Missouri, in place of (Insert Name of Jurisdiction) and January 1, 2016, in place of (Insert Date of Issuance).

8. Appendix H. Delete Section H104.

9. Section 1612.3. Insert: City of Salem, Missouri.

10. Section 1612.3. Insert: February 1979.

11. Section 3412.2. Insert: August 18, 2015.

Section 500.020 Residential Code.

A. A certain document, three (3) copies of which are on file in the office of the Building Inspector of the City of Salem, Missouri, being marked and designated as the International Residential Code, 2012 Edition, including Appendix Chapters A, B, C, F, G, H, J, N, P, Q, as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Salem, in the State of Missouri for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three (3) stories in height with separate means of egress as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Residential Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this Section, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

B. The following sections are hereby revised:

1. Section R101.1. Insert: City of Salem, Missouri, in place of (Name of Jurisdiction).

2. Section R105.2. Subsection 2: Delete - "7 feet" and replace with "3 feet."

Subsection 3: Delete.

Subsection 7: Delete - "24 inches" and replace with "42 inches."

3. Section R106.1. Delete the entire provision and replace with the following:

6. Section R319. Is amended by adding a new Section to be numbered as follows:

319.2. Illumination. Single-family dwellings shall have the ability to illuminate the address and numbers during hours of darkness with a power source connected to the house electrical system or other approved source of illumination.

7. Section 405.1. Is amended by adding "or 18" of washed gravel or crushed rock" at the end of the third sentence.

8. Section 501.3. Delete the entire provision.

9. Section 602.6.1. Is amended by deleting "eight 10d" and adding "four 10d."

10. Section N1101.8. Delete entire provision.

11. Table N1102.1.1. Is amended to read as follows:

12. Section 1102.4.1.2. Shall be amended by inserting "Where required by the Code Official" at the beginning of the first sentence.

13. Section N1103.2.2. Shall be amended by inserting "Where required by the Code Official" at the beginning of the sentence that reads "duct tightness shall be verified by either of the following."

14. Section P2503. Shall be amended by inserting "Where required by the Code Official" at the beginning of the first sentence in Sections P2503.4, P2503.5, P2503.6, P2503.7.

15. Section E3902.2. Shall be amended by inserting the following language at the end of the current language:

Exception: A dedicated receptacle supplying solely a garage door opener, or a refrigerator, or a freezer that is clearly identified as "Not GFCI Protected."

16. Section E3902.5. Is amended by deleting the exceptions provision and replacing it with a new provision to be numbered as follows:

Exceptions:

	1.	A receptacle supplying only a permanently installed fire alarm or burglar alarm and identified as "Not GFCI Protected."
	2.	A dedicated receptacle supplying a sump pump and identified as "Not GFCI Protected."
	3.	A dedicated receptacle supplying a refrigerator and/or freezer and identified as "Not GFCI Protected."

17. Section AG105.2. Subsection 1: Delete "48 and replace with 42 inches."

18. Section AG105.5. Delete entire section and replace with the following:

	1.	Above-ground/on-ground pools less than forty-two (42) inches deep.
	2.	Spas or hot tubs with a safety cover which comply with ASTM F 1346.

19. Section P2603.5.1. Shall be amended to read: Building sewers shall be installed not less than twelve (12) inches below grade.

Section 500.030 Plumbing Code.

A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Salem, Missouri, being marked and designated as the International Plumbing Code, 2012 Edition, including Appendix Chapters C, E, and F, as published by the International Code Council, be and is hereby adopted as the Plumbing Code of the City of Salem, in the State of Missouri regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Plumbing Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

B. The following sections are hereby revised:

1. Section 101.1. Insert: City of Salem, Missouri.

2. Section 106.6.2. See Schedule.

3. Section 106.6.3. Delete.

4. Section 108.4. Insert: Misdemeanor, $500.00, 90 days.

5. Section 108.5. Insert: $25.00; $500.00.

6. Section 109. Means of Appeal Delete Subsection 109.1 — 109.7 and insert the following:

109.1. Appeals: All appeals of orders, decisions or determinations made by the building official relative to the application of this code, all appeals shall be heard and governed by the provisions of Section 520.960 of this Code.

7. Section 305.4.1. Shall be amended to read: Building sewers shall be installed not less than twelve (12) inches below grade.

8. Section 605.2. Delete: "8%" and replace with "0%."

9. Section 903.1. Insert: "6 inches."

Section 500.040 Mechanical Code.

A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Salem, Missouri, being marked and designated as the International Mechanical Code, 2012 Edition, as published by the International Code Council, be and is hereby adopted as the Mechanical Code of the City of Salem, in the State of Missouri regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Mechanical Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

B. The following sections are hereby revised:

Section 500.050 Fuel Gas Code.

A certain document, three (3) copies of which are on file in the office of the City Clerk of the City of Salem, Missouri, being marked and designated as the International Fuel Gas Code, 2012 Edition, as published by the International Code Council, be and is hereby adopted as the Fuel Gas Code of the City of Salem, in the State of Missouri for regulating and governing fuel gas systems and gas-fired appliances as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fuel Gas Code on file in the office of the City of Salem, Missouri, are hereby referred to, adopted, and made a part hereof, as if fully set out in this legislation, with the additions, insertions, deletions and changes, if any, prescribed in Subsection (B) of this Section.

B. The following sections are hereby revised:

1. Section 101.1. Insert: City of Salem, Missouri.

2. Section 106.6.2. Insert: See the Schedule.

3. Section 106.6.3. Delete.

4. Section 108.4. Insert: Misdemeanor, $500.00 and 90 days.

Article II Building Permit Fees

Section 500.060 Rate Schedule.

A. The City of Salem, Missouri, shall adopt the following rate schedule for the issuance of permits and collection of fees pertaining to the adoption of the 2012 International Building Codes, International Plumbing Codes, International Mechanical Codes, International Residential Codes and International Fuel Gas Codes.

A commercial plan review fee is required in addition to the building permit fee. The plan review fee is 65% of the building permit fee. The sum of the fees is the total dollar amount required for permit issuance.

This deposit shall be refunded after final inspection has been approved under a valid and current permit. Should the permit expire or final inspection not be obtained and approved within this timeframe, the deposit shall be forfeited.

Permits/Inspections are Required

When construction has commenced without a permit, the permit fee shall be twice the original amount to cover the additional inspections and the time necessary to insure compliance with the code. When construction has begun under the authorization of a permit, but the permit holder has failed to obtain the required inspection, and the construction has passed the stage in which the inspection can be reasonably done, then an additional 25% of the original permit fee ($25 minimum) will be charged.
