All existing sidewalks, curbs or gutters that have been constructed
on streets in the Borough shall be maintained by the property owner
in a smooth and safe condition.

If the Streets, Buildings and Grounds Committee or Borough Engineer
shall determine that sidewalks, curbs or gutters abutting any property
are in a poor or unsafe condition, the property owner shall be notified
by the Borough Engineer.
The notice referred to in §
395-2 shall contain a description of the property, a description of the repairs to be made and a statement that, unless the owner or owners complete the same within 30 days after service thereof, the municipality will undertake to make the repairs at the expense of the owners.
After the property owner fails to make the repairs specified in the notice set forth in §
395-2 within the thirty-day period, the repairs shall be made by the municipality and the cost thereof assessed against the property as a municipal lien.
Nothing in the foregoing sections shall remove the liability
of the property owner to maintain sidewalks, curbs or gutters in a
safe condition.
All work done under the foregoing provisions shall be under
the supervision of the Borough Engineer.
