The City Council shall, at its first meeting or as soon thereafter
as possible, appoint by a majority vote the following officers: a
Chief Administrative Officer, a City Attorney, a Municipal Judge and
a City Clerk. Such officers may be removed from office at any time
by a vote of a majority of the members of the Council, except as otherwise
provided by this Code, other City ordinance or by the laws of the
state.

Any officer of the City who shall leave the City with the intention
of residing outside the City shall thereby vacate his office and thereupon
the proceedings provided for in case of a vacancy shall be had.

All officers appointed by the City Council serve at the will
of the Council and not by virtue of any right unless otherwise provided
by law.

All officers of the City charged with the custody of moneys,
bonds and obligations, and other property belonging to the City are
expressly prohibited from using such property, directly or indirectly,
for their own profit or benefit, under penalty of immediate removal
from office and other punishment provided by law for such offenses.

Any officer of the City who shall refuse or willfully fail or
neglect to perform any duty enjoined upon him by law or ordinance,
or who shall, in the discharge of his official duties, be guilty of
any fraud, extortion, oppression, favoritism, partiality, or willful
wrong or injustice shall be removed from office.

It shall be the duty of all officers of the City charged with
the collection, disbursement or custody of City revenue, from whom
annual reports are required, to submit monthly reports to the Chief
Administrative Officer. The monthly reports shall embrace a full statement
of the monthly receipts and expenditures of their respective offices
and such other matters as may be required by this Code or any other
City ordinance, resolution or otherwise, for the preceding fiscal
year.
