In accordance with Chapter 44, RSMo. (1978), there is hereby
established within and for the City of Kirkwood, Missouri, an emergency
management organization to be known as the "Kirkwood Office of Emergency
Management," responsible for the preparation and implementation of
emergency management plans to minimize injury and loss due to a serious
emergency or disaster.

The Office of Emergency Management shall consist of a Director
appointed by the Chief Administrative Officer, and other members as
shall be appointed by the Chief Administrative Officer when deemed
necessary.

This office shall be responsible for emergency management functions
for the City of Kirkwood, Missouri, within the City limits, and may
function outside the City limits in accord with St. Louis County mutual
aid agreements or contracts, and/or by direction of the governor,
pursuant to provisions of Chapter 44, RSMo. (1978), and supplements
thereto.

The Director shall be appointed by the Chief Administrative Officer. The Director shall be responsible for the organization, administration and operation of Kirkwood emergency management functions as outlined in §§
7 1/2-2 through
7 1/2-3 of this chapter.

The Mayor or the Chief Administrative Officer, in accord with
provisions of Chapter 44, RSMo. (1978), and supplements thereto, may:
(1)
Declare a state of emergency within the City of Kirkwood, Missouri.
(2)
Expend funds, make contracts, obtain and distribute equipment,
materials and supplies for emergency management purposes; provide
for the health and safety of persons, including emergency evacuation
and assistance to victims of an emergency, disaster, or enemy attack;
provide for the safety of property; direct and coordinate the development
of disaster plans and programs in accordance with the policies and
plans of the federal and state disaster emergency planning.

Appoint, provide or remove rescue teams, auxiliary fire and
police personnel and other emergency operations teams, units or personnel
who may serve without compensation.
(4)
In the event of enemy attack or declared emergency, waive the
provisions of statutes requiring advertisements for bids for the performance
of public work or entering into contracts.
(5)
With the approval of the Governor and consistent with the Missouri
Emergency Operations Plan, enter into the mutual aid agreements with
other public and private agencies within and without the state for
reciprocal emergency aid.
(6)
Accept services, materials, equipment, supplies or funds granted
or loaned by the federal government for disaster planning and operations
purposes.

The Mayor, Chief Administrative Officer, emergency management
Director, Police Chief, Fire Chief; and other individuals as may,
from time to time, be appointed and removed by the City Council, shall
comprise the Emergency Management Council of Kirkwood.

The Chief Administrative Officer may provide City owned or leased
office space and facilities for the Office of Emergency Management.
