As used in this chapter, the following terms shall have the
meanings indicated:
PERSON
Includes any individual or individuals, partnership, association
or corporation, singular or plural, including the responsible officers
of any such association or corporation.
No person or persons shall, at or in any place within the Borough,
create, make or engage in any riot or violent assembly.
A. No person shall discharge any firearm, air rifle, bow and arrow or
spring gun of any type whatsoever, except as authorized by state law.
B. No person shall carry any concealed deadly weapon, except persons
duly authorized by state law.
No person shall sell, use or discharge fireworks, firecrackers
or other pyrotechnics in any public or private place, except as authorized
by state law.
A. No person shall conduct, attend or in any manner whatsoever participate
in any exhibition of an indecent or immoral character.
B. No person shall make any immodest, immoral, lewd or other indecent
sign or gesture, or do or commit any other immodest, immoral, lewd
or indecent act to or in the presence of any other person or persons
in any public street, highway or place within the Borough.
No person shall operate, maintain, frequent or participate in
the operation or maintenance of any house of prostitution or assignation
or any gambling house or any house or building in which unlawful and
disorderly acts occur.
No person, except a public officer legally thereunder authorized,
shall affix any show bill, placard, poster or other advertising device
upon any pole, tree or structure within the Borough without first
obtaining the consent of the owner thereof.
No person shall wrongfully strike another or be engaged in any
fight or affray, or be or appear in a drunken or intoxicated condition
in any public street, highway or public place within the Borough.
No person shall consume any alcoholic beverages on any public street,
highway, alley or any public place other than premises licensed to
sell such alcoholic beverages for consumption on the premises.
No person shall willfully and unnecessarily obstruct or interfere
with travel upon any foot pavement, sidewalk or public passageway;
nor shall any person lounge, loiter and loaf thereon or therein or
upon any street corner or public building, provided that this chapter
shall not be construed to restrict peaceful picketing, so long as
1/2 of the width of the sidewalk is kept clear for the use of other
pedestrians. It shall be unlawful for four or more persons without
lawful purpose to congregate on any street, highway, alley, sidewalk
or other public place, there to loiter to the impediment or annoyance
of orderly persons passing or residing on, at or near the said street,
highway, alley, sidewalk or other public place.
No person shall falsely impersonate a police officer or any
other officer belonging to the Police Department of the Borough; nor
shall any person, with the intention to deceive, use or imitate any
sign, signal or device thereof; nor shall any person obstruct or resist
any of said officers in the performance of official duty; nor shall
any person in any manner aid any prisoner in custody to escape or
attempt to escape.
No person shall cast or discharge any refuse into or upon any
of the streets, alleys, public places or upon the property of others
within the Borough.
No person shall deface, disfigure, write upon or in any manner
cause to be placed upon any house or wall or building of any kind
whatsoever, or in any part thereof, or upon fences or road signs,
any marks, lines, figures, letters or caricatures of any kind.
A. No person shall use any instrument or device for the purpose of attracting
attention by the creation of noises to any place of business or amusement.
The use of any such device outside of, or near an open door or window
of, any such place shall be presumed to be for such purpose.
B. No person shall willfully make or cause to be made any loud, boisterous
or unseemly noise or disturbance whereby the public peace is broken
or disturbed.
No person shall originate any false alarm of fire.

Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding under the Pennsylvania
Rules of Criminal Procedure, be guilty of a summary offense and shall
be punishable by a fine of not more than $1,000, plus court costs
and reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings. Upon judgment against any person by summary conviction,
or by proceedings by summons on default of the payment of the fine
or penalty imposed and the costs, the defendant may be sentenced and
committed to the county correctional facility for a period not exceeding
30 days. Each day that such violation exists shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense. In addition to or in lieu of enforcement
under this section, the Borough may enforce this chapter in equity
in the Court of Common Pleas of Chester County.

Any public street, roadway, right-of-way, and/or alley and/or
any private street, roadway, and/or alley used by the public.
A. No person shall throw, strike, propel or otherwise cause balls, stones,
missiles or other materials or objects of any kind, to be in, or enter
into, onto, across, through or over any Street.
B. No pedestrian shall obstruct or interfere with any vehicle being
operated upon any Street; loiter on such Street; or engage in any
activity which would place him/her in danger of being struck by any
vehicle operated on a Street or cause an unsafe traffic situation.
A. Enforcement. This Ordinance shall be enforceable by Borough police
officers.
B. Any person who violates or permits a violation of this chapter shall,
