A. 
Whereas severe drought conditions may result in drastic depletion of the available capacity of the Charter Township of Huron's water supply system;
B. 
Whereas, said depletion may cause a reduction in water pressure levels which threatens a total loss of water supply to areas of the Township of Huron, endangering the health, safety and general welfare of the community;
C. 
Whereas, the Huron Township Board deems it necessary to respond to a drought emergency situation with the adoption of an ordinance mandating conservation of the available capacity of the Charter Township of Huron water supply system.
A. 
A water supply emergency shall be deemed to exist whenever the Supervisor of Public Works finds on the basis of drought conditions, depletion of water supply, reduction in water pressure or other reasons that there is a threat of loss of water supply to the community or a portion of the community, and causes a declaration of such water supply emergency to be publicly announced by any media or communications available within a normal operating range covering Huron Township.
B. 
The Department of Public Works Supervisor shall make or cause to be made a record of each time and date when any declaration is announced to the public in accordance with Subsection A of this section.
C. 
A water supply emergency shall be deemed to exist irrespective of whether broadcast notification is provided under Subsection A as to persons otherwise provided with direct notice of such a water supply emergency.
During a water supply emergency, it shall be unlawful for any person to utilize water from the Charter Township of Huron water supply system for any type of outdoor use, other than responding to a fire emergency. The prohibition shall remain in effect 24 hours per day, seven days per week until the water supply emergency is declared ended by the Supervisor of Public Works. The Department of Public Works Supervisor may provide for a more limited prohibition when he determines that such a limited prohibition will be sufficient to protect the capacity of the water supply system. The terms of such a limited prohibition shall be made a part of the emergency declaration. The Department of Public Works Supervisor may provide exceptions to the prohibition of this section where necessary to prevent imminent financial loss to a water user.
Any person who violates any provision of this article shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding $500 or imprisonment in the county jail for a period not exceeding 90 days, or engagement in community service, or any combination of such fine, imprisonment and community service, in the discretion of the court, together with the costs of such prosecution.
