The office of Township Manager is hereby created by the Township
of Upper Makefield, subject to the right of the Township, by ordinance,
at any time to abolish such office.
The Township Manager shall be selected by a majority vote of
all members of the Board of Supervisors of Upper Makefield Township
and shall be subject to removal at any time by a majority vote of
all the members of the Board of Supervisors.
The Manager shall be chosen solely on the basis of demonstrated
executive and administrative abilities, with special reference to
experience in or knowledge of accepted practices in respect to the
duties of the office herein outlined. The Manager need not be a resident
at the time of appointment. The residency requirement, if any, for
the Manager, will be established by resolution of the Board of Supervisors.
Before entering upon the duties of the office, the Township
Manager shall give a bond to the Township, with a bonding company
as surety, in an amount as shall be fixed from time to time by resolution
of the Board of Supervisors, said bond being conditioned for the faithful
performance of such duties, premium for said bond to be paid for by
the Township of Upper Makefield.
The Manager shall be the chief administrative officer of the
Township, and shall be responsible to the Board of Supervisors as
a whole for the proper and efficient administration of the affairs
of the Township. The powers and duties shall relate to the general
management of all Township business not expressly, by statute, resolution
or ordinance, imposed or conferred upon other Township officers. (The
Board of Supervisors, by majority vote, is hereby authorized to delegate
to the Township Manager, subject to recall by written notification
at any time, any of its nonlegislative and nonjudicial powers and
duties.)
Subject to recall by ordinance, the powers and duties of the
Manager shall include the following:
A. Recommending to the Board of Supervisors on the hiring, and when
deemed necessary for the good of the service, the suspension or discharge
of employees under the Manager's supervision.
B. Recommending to the Board of Supervisors a standard schedule of pay
for all employees under the Manager's supervision.
C. Preparation and submission to the Board of Supervisors before the
close of the fiscal year, or on such alternative date as the Board
of Supervisors shall determine, a budget for review and approval by
the Supervisors for the next fiscal year and an explanatory budget
message. Upon adoption of a budget, the Manager shall be responsible
for the administration of the same.
D. Preparation and submission to the Board of Supervisors as of the
end of the fiscal year a complete report on the finances and administrative
activities of the Township for the preceding year.
E. Keeping the Board of Supervisors advised of the financial condition
and future needs of the Township, and making such recommendations
as are deemed desirable. The Manager shall prepare, periodically,
recommendations as to a capital expense budget, and shall also prepare
a quarterly report on current budget expenditures.
F. Recommending to the Board of Supervisors from time to time adoption
of such measures as are deemed necessary or expedient for the health,
safety or welfare of the community or for the improvement of administrative
services.
G. The Manager shall, under the direction of the Board of Supervisors,
execute and enforce the laws of the commonwealth, and ordinances,
resolutions and the bylaws of the Township.
H. The Manager shall attend all meetings of the Township Board of Supervisors
and of its committees, with the right to take part in the discussion,
and shall receive notice of all special meetings of the Board of Supervisors
and of its committees.
I. Preparing the agenda for each meeting of the Board of Supervisors
and supplying facts pertinent thereto.
J. Assuring that the provisions of all franchises, leases, permits and
privileges granted by the Township are observed.
K. Supervising the performance and faithful execution of all contracts,
except insofar as such duties are expressly proposed by statute upon
some other some Township officer.
L. Assuring that all money owed the Township is promptly paid and that
proper proceedings are taken for the security and collection of all
the Township's claims.
M. The Manager shall be the purchasing officer of the Township and shall
purchase, upon receiving approval of the Board of Supervisors, all
supplies and equipment for the agencies, boards, departments and other
offices of the Township. The Manager shall keep an account of all
purchases and shall, from time to time, or when directed by the Board,
make a full written report thereof. The Manager shall also issue rules
and regulations, subject to the approval of the Board, governing the
procurement of all municipal supplies and equipment.
N. The Manager shall investigate all complaints in relation to matters
concerning the administration of the government of the Township, and
report all such investigations to the Board of Supervisors. All complaints
regarding Township services shall be referred to the office of the
Manager, who shall then so notify the Board of Supervisors. The Manager,
or an officer designated by the Manager, shall dispose of such complaints,
and the Manager shall report thereon to the Board of Supervisors.
O. The Manager shall supervise the writing of all reports and correspondence.
P. The Manager shall cooperate with the Board of Supervisors at all
times and in all matters that the best interest of the Township and
of the general public may be maintained.
Q. The Manager shall perform such other duties as may be required by
the Board of Supervisors.
R. The Board
of Supervisors may enter into an employment agreement with the Township
Manager consistent with Section 1301 of the Pennsylvania Second Class
Township Code.,
The salary of the Township Manager of the Township of Upper
Makefield shall be established, from time to time, by resolution of
the Board of Supervisors.
