No wood-burning stove shall be installed in any building or
structure unless the owner or applicant has obtained a wood-burning
stove permit issued by the Upper Makefield Township.
Unless otherwise expressly stated, the following terms have
the meanings indicated in this section. When terms are not defined,
they shall have ascribed to them their ordinary accepted meanings
such as the context herein may imply.
ADMINISTRATIVE AUTHORITY
The individual official, board, department or agency established
and authorized by a political subdivision created by law to administer
and enforce the provisions of this Part.
APPLIANCE, APPROVED
An appliance accepted or acceptable under an applicable nationally
recognized standard accepted as suitable for the proposed use under
procedures and powers of the administrative authority, or accepted
by a nationally recognized testing or inspection agency.
CHIMNEY
A primarily vertical enclosure containing one or more passageways.
A.
Chimney; low-heat appliance type. An approved chimney for removing
the products of combustion from fuel-burning, low-heat appliances
producing combustion gases not in excess of 1,000° F. under normal
operating conditions but capable of producing gases of 1,400°
F. during intermittent force-firing for periods of up to one hour.
All temperatures shall be measured at the appliance flue outlet.
B.
Chimney, medium-heat appliance type. An approved chimney for
removing the products of combustion from fuel-burning, medium-heat
appliances producing combustion gases not in excess of 2,000°
F. measured at the appliance fuel level.
CHIMNEY, FACTORY-BUILT
A chimney that is factory-made and listed by a nationally
recognized testing or inspection agency for venting gas appliances,
gas incinerators and solid or liquid fuel-burning appliances.
CHIMNEY, METAL
Field-constructed chimney made of metal and built in accordance
with nationally recognized standards.
CHIMNEY CONNECTOR
A pipe which connects a fuel burning appliance to a chimney.
(See "breeching.")
CHIMNEY LINER
The lining material of approved fire clay or other approved
material.
CHIMNEY MASONRY
A field-constructed chimney of solid masonry units, bricks,
stones, listed hollow masonry units or reinforced concrete built in
accordance with nationally recognized standards.
DAMPER
A manually or automatically controlled device to regulate
draft or the rate of flow of air or combustion gases.

BACKDRAFT DAMPER (SHUTTER)A device which, when mounted in a duct or opening, permits the flow of air in one direction only. It is normally opened by the energy of the air stream but may be opened and/or closed by external mechanical means.
FLUE CONNECTION (BREECHING)
A passage for conducting the products of combustion from
a fuel-fired appliance to the vent or chimney (see also "chimney conductor"
and "vent conductor").
GRATE
Surface with suitable openings to support the fuel bed and
permit passage of air through the burning fuel. It is usually located
in the primary combustion chamber and is designed to permit removal
of unburned residue and may be horizontal or inclined, stationary
or movable.
HEAT EXCHANGERS
A device used for the transfer of heat from one medium to
another.
INTERCHANGEABILITY
Words used in the present tense include the future; words
in the masculine gender include the feminine and neuter; the singular
number includes the plural and the plural the singular.
LISTED
Products which are shown in a list published by a nationally
recognized testing or inspection agency and whose listing states that
the product complies with nationally recognized safety standards.
MANUFACTURER
The company or organization which evidences its responsibility
by affixing its name or nationally registered trademark or trade name
to the equipment.
NATIONALLY RECOGNIZED TESTING OR INSPECTION AGENCY
One acceptable to the authorities having jurisdiction that
provides uniform testing and examination procedures under established
standards, is properly organized, equipped and qualified for testing,
and has a follow-up inspection service of the current production of
the listed products (see Appendix A).
NONCOMBUSTIBLES
Materials which pass the test procedures (for defining noncombustibility
of elementary materials) set forth in ASTM E 136 when exposed to a
furnace temperature of 1,382° F. for a period of five minutes,
and do not cause a temperature rise of the surface or interior thermocouples
in excess of 54° F. above the furnace air temperature at the beginning
of the test and which do not flame after an exposure of 30 seconds.
SEALED COMBUSTION CHAMBER APPLIANCES
Appliances which are so constructed and installed that all
air for combustion is derived from the outside atmosphere, and all
flue gases are discharged to the outside atmosphere.
All wood-burning heating appliances shall be at least 36 inches
from all combustible materials. Where clearance is less than 36 inches
but more than 18 inches, the combustible surface shall be protected
by one-quarter-inch asbestos millboard covered 28 gauge metal spaced
one inch or more from combustible surface, or manufacturer recommendations.
Adequate space shall be provided to permit air circulation. If clearance
is less than 18 inches but more than 12 inches, the combustible wall
shall be protected by a four-inch brick veneer, extending two feet
above and two feet beyond each side of heating appliance:
A. All wood-burning equipment that have circulating devices shall be
at least 24 inches from a combustible surface unless the appliance
has a rating for lesser distance from combustible surface.
B. If the distance of circulating wood-burning appliance is 12 to 24
inches from a combustible surface, the surface shall be protected
by one-quarter-inch asbestos millboard spaced one inch or more from
the walls with adequate one-inch spacing from the floor to permit
air circulation between wall and shield.
C. If the circulating wood-burning equipment is eight to 12 inches from
a combustible surface, the surface shall be protected by one-quarter-inch
asbestos millboard covered with 28 gauge metal spaced one inch or
more from the wall and floor to permit air circulation.
D. Noncombustible material shall extend at least 18 inches beyond the
stove which ashes are removed from and at least six inches beyond
sides and rear.
E. Where stove legs are at least 18 inches above a combustible surface,
a 24 gauge sheet metal or other suitable approved noncombustible material
shall be used.
F. Where stove legs are between six inches and 18 inches above a combustible
surface, a 24 gauge sheet metal over one-quarter-inch layer of asbestos
millboard or other approved noncombustible material shall be used.
G. Where stove legs are six inches or less above a combustible surface,
a four-inch hollow masonry pad should be laid or an approved noncombustible
surface of not less than an inch thickness shall be used.
The Upper Makefield Township Fire Marshal and/or his designee
shall have the right to inspect the installation of the freestanding
wood-burning stove in process and require any modification or requirements
which in their judgment are necessary.
The permittee shall notify the Upper Makefield Township Fire
Marshal upon completion of the installation and prior to operating
the stove so that a final inspection of the installation can be made.
Any faults and/or deficiencies noted must be corrected to the satisfaction
of the Upper Makefield Township Fire Marshal before the stove will
be certified for operation. Operation of the wood-burning stove without
certification by the Township Fire Marshal will be in violation of
this Part.
The fee for a permit for the installation of a wood-burning
stove shall be established from time to time by the Board of Supervisors
of Upper Makefield Township by resolution.

Any person, firm or corporation who shall violate any provision
of this Part shall, upon conviction thereof, be sentenced to pay a
fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 30
days. Each day that a violation continues shall constitute a separate
offense.
