With respect to all lands adjacent to public highways within the Town of Pine Plains, except those defined by §
222-7 of this article, there shall not be placed any obstructions of the character defined in §
222-7 along the highway for a distance, measured from the center line of the highway, of three rods, it being the intent of this article to facilitate snow removal and other highway maintenance in a manner not to be injurious either to highway or other equipment utilized by the Town for such purposes or to injure property situated on lands adjacent to public highways.
Any person convicted of a violation of this article shall be
deemed to have committed a violation of it and shall be subject to
a fine not exceeding $250 or imprisonment not to exceed a term of
15 days. In addition thereto, the Town is empowered to commence an
action in law or in equity in a court of competent jurisdiction to
compel compliance with or to restrain by injunction a violation of
this article, notwithstanding the provisions contained herein for
penalties or other punishment.
