The title of this Part shall be "The Newtown Township Skateboarding
Ordinance."

As used in this Part, the following terms shall have the meanings
indicated:
SKATEBOARD
A platform which is mounted on wheels, having no mechanical
parts for propelling or braking the device, which is operated by standing
upon the platform, and propelled by the rider or by gravity.

No person shall use, operate or ride upon, nor permit the use,
operation or riding upon any skateboard on any public street, public
alley, public sidewalk, public park, public parking lot or other public
place within Newtown Township, nor shall any person use, operate or
ride a skateboard in any private area in Newtown Township upon which
the owner has posted "No Skateboarding" signs and has requested in
writing to Newtown Township that this Part be enforced.

The Newtown Township Police Department shall have the exclusive
authority to enforce the provisions of this Part. Enforcement of the
provisions of this Part on privately owned property shall be by the
Newtown Township Police Department upon notification by the owner
of said property to the Newtown Township Police Department that the
owner desires to have the provisions of this Part enforced upon the
owner's property.

Signs reading "No Skateboarding" shall be posted upon private
property where skateboarding is prohibited.

1. Any person who shall violate any provision of this Part shall be
subject to the penalties set forth below:
A. First Violation. A warning shall be given for the first violation
of this Part, and the violator's name shall be recorded by the Newtown
Township Police Department.
B. Second
and Subsequent Violations. Any person, firm or corporation who shall
violate any provision of this Part a second or subsequent time shall,
upon conviction thereof in an action brought before a district justice
in the manner provided for the enforcement of summary offenses under
the Pennsylvania Rules of Criminal Procedure, shall be sentenced to
pay a fine of not more than $1,000 plus costs and, in default of payment
of said fine and costs, to a term of imprisonment not to exceed 90
days. Each day that a violation of this Part continues or each Section
of this Part which shall be found to have been violated shall constitute
a separate offense.
