When used in this Part, the following terms shall have the following
definitions:
ON OR ABOUT THE PERSON
The location of a bottle, can or other container containing
an alcoholic beverage which is nearby, close at hand, convenient of
access and within such distance of a person such that the person can,
without materially changing position, reach it.
OPEN CONTAINER
A container whose cork, cap, top or other seal has been removed,
punctured, pulled open or broken or a container which has no top,
such as a cup or glass.
PUBLIC PLACE
Any and all streets, sidewalks, boulevards, alleys or other
public ways and any and all public parks, squares, spaces, grounds
and buildings.

No person shall have on or about his or her person, possess,
carry or transport liquor, wine, beer or any other alcoholic beverage
in open containers in or upon any public place in the Township of
Newtown. Further, no person shall consume liquor, wine, beer or any
other alcoholic beverage in or about any public place in the Township
of Newtown.

Any person who violates any provision of this Part shall, upon
conviction in a summary proceeding before any District Justice, be
subject to a fine not exceeding $300 plus costs and reasonable attorney's
fees, and in default of payment thereof shall be subject to imprisonment
for a term not to exceed 30 days.
