1. 
All trees, plants, shrubbery, bushes, and other vegetation shall be kept cut and trimmed by the owner of the property on or in front of which they are located:
A. 
So as not to interfere with the proper lighting of the public highways and streets by the street lights, and so as not to interfere with the passage of pedestrians and vehicles, and so as not to interfere with vision of traffic at intersecting streets and avenues.
B. 
So that the minimum clearance between any sidewalk and any overhang ing portion shall be not less than eight feet, and so that the minimum clearance between any public highway or street at the curb line and any overhanging portion shall be not less than 13½ feet. Provided; the Mayor shall have the authority to designate a higher clearance on any public highway or street, where heavy traffic or other conditions make it expedient.

If any property owner or owners shall neglect or refuse to cut, trim, or removal any portion of any trees, plants, shrubbery, bushes, or other vegetation as required by this Chapter after 10 days' notice in writing by the Mayor so to do, the said Mayor may cause such cutting, trimming or removing to be done at the expense of the owner of said premises, and the entire cost thereof shall be a lien upon said premises and a claim therefore shall be filed and collected by the Borough Solicitor, in the same manner as municipal claims are filed and collected, or the Borough Solicitor may sue the said owner or owners of the said property for and on behalf of the said Borough, in an action of assumpsit to collect the entire cost thereof.

Any person, firm or corporation who shall violate any provision of this Part, upon conviction thereof in an action brought before a magisterial district judge in the manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure, shall be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 90 days. Each day that a violation of this Part continues or each Section of this Part which shall be found to have been violated shall constitute a separate offense.
