1. 
The placement of the following items within the cartway or right of way of any public street within Manchester Township or within the clear sight triangle of any intersection within Manchester Township is strictly prohibited and hereby declared a nuisance:
A. 
Sports equipment of any kind including but not limited to:
(1) 
Basketball goals or nets whether permanent or temporary.
(2) 
Skateboarding ramps, half-pipes or rails.
(3) 
Soccer or hockey goals or nets.
(4) 
Bicycle ramps.
B. 
Unattached trailers whether legally licensed or not.
C. 
Unlicensed, uninspected or inoperable motor vehicles.
D. 
Building or landscaping materials of any kind including but not limited to:
(1) 
Piles of stone or rock.
(2) 
Piles of mulch.
(3) 
Piles of topsoil or fill material.
(4) 
Grass clippings whether piled or blown.
(5) 
Sod.
(6) 
Lumber.
(7) 
Firewood.
(8) 
Asphalt.
E. 
Portable or chemical toilets.
F. 
Temporary signs.
(1) 
On detached trailers.
(2) 
Non-incidental vehicular signs.
(a) 
Defined as "Signs affixed to a vehicle in such a manner that the carrying of the sign or signs is no longer incidental to the vehicle's primary purpose of transportation, but rather becomes a primary purpose in itself."
(3) 
Banners.
(4) 
Signs announcing open houses, housing developments or proposed developments.
(a) 
Whether the development is located in Manchester Township or not.
(5) 
Signs offering employment, services or goods located within the right of way of any street.
(a) 
Includes any sign placed on any utility pole or traffic control sign post or structure.
G. 
Snow.
(1) 
The throwing, pushing, blowing, placing or plowing of snow from private property into or onto a cartway of any street.
(2) 
Piling snow more than three feet high within the clear sight triangle of any intersection of any street.
2. 
The placing of or positioning any foreign substance or material into any storm sewer inlet or pipe is hereby prohibited.
A. 
Shall include positioning of any foreign substance or material so that it can enter a storm sewer inlet or pipe.

1. 
The following are excepted from being declared a nuisance under these provisions:
A. 
Any material placed in the street or cartway or right of way of any street or cartway in Manchester Township by or under the direction of Manchester Township or PennDOT.
(1) 
For public works projects or for the maintenance of any street or cartway, sanitary sewer lines, storm sewer lines.
(2) 
Any work for which a highway occupancy permit has been first authorized and permitted by Manchester Township or PennDOT.
(3) 
Any barricades or prohibition to travel authorized by Manchester Township or PennDOT.
(a) 
To protect the motoring or general public from a dangerous situation.
B. 
An authorized gathering such as a block party or neighborhood gathering.
(1) 
Prior permission from the Manchester Township Board of Supervisors has been gained.
(a) 
Provisions have been made for emergency vehicles to access the street or area.
C. 
A parade authorized by Manchester Township or PennDOT.
D. 
The piling of leaves within a street or cartway right of way no more than 24 inches from any curb line or street line during the months of October, November or December for the express purpose of collection by Manchester Township during the annual leaf collection process.
E. 
Snow placed in the cartway of any street or in the clear sight triangle by any agency of any government clearing snow from the public streets, roads and highways.

1. 
Any of the described obstructions are nuisances and are a hazard to the public and shall be removed immediately from the streets, cartways or the right of way of any street or cartway within Manchester Township.
A. 
Immediate removal shall be defined as before the time of sunset of the date of notification.
(1) 
Notification may be given in person by an authorized representative of Manchester Township; or,
(2) 
By certified mail.
2. 
Manchester Township shall have the right to remove any object or unauthorized item occupying any street or cartway or any right of way of any street or cartway if Manchester Township determines that an immediate hazard to public safety exists.
A. 
The owner of the obstruction or the persons responsible for the objects placement shall be responsible for the township's cost of removal, storage or disposal of the removed object, item or obstruction.

1. 
The provisions of this Part shall be enforced by:
A. 
The Police Department serving Manchester Township.
B. 
The Manchester Township Public Works Superintendent.
C. 
Building Permit Officer.
D. 
Zoning Officer.
E. 
Any other appropriate officer or officers of Manchester Township.
2. 
Any person who violates or fails to comply with any provision of this Part shall, upon conviction thereof in a summary proceeding, be fined not more than $600 and the costs of prosecution and, in default of payment thereof, shall be imprisoned for not more than 30 days. A separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues.
