This chapter shall be known as the "Subdivision and Land Development Ordinance of the Township of Manchester."

1. 
The purpose of this Subdivision and Land Development Chapter is to provide for the harmonious development of the Township by:
A. 
Ensuring conformance of subdivision and land development plans with the Comprehensive Plan, Zoning Ordinance [Chapter 27], public improvement plans and other adopted regulations.
B. 
Assisting in the orderly and efficient integration of land development within the Township.
C. 
Ensuring the provision of adequate public facilities including, but not limited to, roadways, walkways, street lighting, water supply, storm and sanitary sewage facilities, recreation and open space, and other necessities and amenities to the general welfare of the Township residents.
D. 
Protecting the environmental resources of the Township.
E. 
Providing standard procedures for equitable processing of all subdivision and land development plans.
F. 
Encouraging and promoting flexibility and ingenuity in the layout and design of subdivisions and land developments.
G. 
In general, promoting the greater health, safety, morals and general welfare of the citizens of the Township.

1. 
All plans for subdivision and land development within Manchester Township shall first be submitted to the Manchester Township Planning Commission.
A. 
The Township's Planning Commission shall be empowered to review said plans.
(1) 
Either alone; or,
(2) 
Jointly with the Manchester Township Board of Supervisors.
(a) 
To formulate a recommendation as to the plan's approval (whether conditional or final) or rejection of any plan.
(b) 
As provided for in Pennsylvania Act 247, as amended, (Pennsylvania Municipalities Planning Code, Article V, § 501, 53 P.S. § 10501).
2. 
The Manchester Township Board of Supervisors shall be vested with final authority over subdivision and land development in the Township.

1. 
Plans for subdivision and land development located within Manchester Township shall be submitted to the York County Planning Commission for review and report.
A. 
As required by § 502 of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10502.
B. 
Said submission shall take place before final approval of any plans by the Board of Supervisors.
(1) 
If a report is not received from the County Planning Commission within 45 days after submission, the Board of Supervisors may proceed without the report.
C. 
The report of the County Planning Commission is advisory; and,
(1) 
Should include comments of any plan's conformance with the County's Comprehensive Plan.
(2) 
Shall be accepted or rejected in whole or in part as the Board of Supervisors shall determine.

1. 
Except in accordance with the provisions of this chapter.
A. 
No subdivision or land development of any lot, tract or parcel of land shall be made.
B. 
No street, sanitary sewer, storm sewer, water main or other improvements in connection therewith shall be:
(1) 
Laid out.
(2) 
Constructed.
(3) 
Opened.
(4) 
Dedicated for public use or travel.
(5) 
Or, for the common use of occupants of buildings abutting thereon.
