1. 
A plan may be considered and labeled as a final minor subdivision plan if:
A. 
Creates three or fewer lots including the parent parcel.
B. 
Does not involve the installation or modification of any:
(1) 
Streets or dedication (except for additional right-of-way width along an existing street).
(2) 
Sanitary sewer mains or extensions.
(3) 
Storm drain or appurtenant structures.
(4) 
Stormwater management basins.
2. 
Requirements for a sketch plan and preliminary plan may be waived if it is determined that a subdivision or land development plan qualifies as a final minor plan.
3. 
May proceed directly to the procedures and requirements of a final plan.

1. 
For any replatting or resubdivision of land, the same procedures and regulations apply as prescribed for an original subdivision.
2. 
Lot sizes may not be varied on a plan after original recording unless a new subdivision is submitted reviewed and approved by the Township.
3. 
Replatting or the resubdivision of any lands previously subdivided are subject to Township approval only if a new subdivision plan is submitted; and:
A. 
Drainage easements or rights-of-way, if changed, are in conformance with the Township regulations in effect at the time of the plan submission so as not to interfere with the purpose of the easements or rights of way.
B. 
Street alignments and block sizes are in conformance with the Township regulations in effect at the time of the plan submission.
C. 
The property lines between the backs of the lots are not changed unless approved by all property owners involved.
D. 
The rear portion of lots are not subdivided from the front part as separate parcels.
E. 
Any new lot created shall conform to the Township regulations in effect at the time of the proposed subdivision.
F. 
The character of the area is maintained.

1. 
For the purposes of straightening lot lines and additions of small, nonbuildable parcels of property to existing recorded lots, said lots shall possess the following characteristics:
A. 
The parcel to be added shall be of such a size that it may not be utilized as a buildable lot.
B. 
No structure may be built on this parcel to be added to the original lot unless in conformance with all Township regulations.
C. 
The parcel to be added must be contiguous to the existing lot.
D. 
Any residual lot(s) must be in conformance with Township regulations in effect at the time of the proposed subdivision.
2. 
The plan prepared for the addition of this parcel shall follow the procedures as outlined for minor subdivisions.
3. 
The plan must include wording indicating that the parcels are hereby joined together and must not be separated without approval of Manchester Township.

Manchester Township does not permit the combination of the subdivision of lots and land development on the same plan as each has unique circumstances and situations.

The Board of Supervisors may grant a waiver from or modification of any mandatory provision, so that substantial justice may be done and the public interest secured while permitting the reasonable utilization of the property.
A. 
If the literal compliance with any mandatory provision of this chapter is shown by the applicant, to the satisfaction of the majority of the members of the Board of Supervisors present at a scheduled meeting, to be:
(1) 
Unreasonable; or,
(2) 
To cause unique or undue hardship as it applies to a particular property; or,
(3) 
That an alternative proposal will allow for equal or better results than the ordinance requirements.
2. 
The granting of a waiver or modification shall not have the effect of:
A. 
Making null and void the intent and purpose of this chapter.
B. 
Altering the mandatory procedural time periods for the review of preliminary or final plans.
3. 
Requests for a waiver or modification shall be:
A. 
Made in writing stating the reason for request for the waiver; and,
B. 
Noted on the body of the plan by the applicant by:
(1) 
Listing the provision's related section number.
(2) 
Specifying the waiver requested.
(3) 
Allowing a space for the date of any approval of the request.
C. 
Shall be submitted for review by the Township's Planning Commission.
D. 
The Board of Supervisors may also request recommendations from any of the agencies reviewing the plan.
E. 
In granting a waiver or modification, the Board of Supervisors may impose such conditions as will in its judgment secure substantially the objectives of this chapter.
F. 
Action on the waiver or modification shall be entered in the minutes of the Board of Supervisors and communicated to the applicant.
(1) 
Failure of the Board of Supervisors to render a decision on the request for a waiver or modification and communicate it to the applicant shall be deemed to be a denial of the request.

1. 
The regulations embodied in this chapter are the minimum standards for the protection of the public welfare.
A. 
When special circumstances warrant, the Township may impose stricter standards.
