A "private swimming pool," for the purposes of this Part, is
defined as an artificial pool or body of water with a depth in excess
of 18 inches and/or diameter of 10 feet. This shall include both excavated
and aboveground pools.

All private swimming pools in the Borough of Hatfield shall be constructed so as to comply with the minimum setback and side yard requirements of structures in the pertinent zone, as set forth in Chapter
27, Zoning, as amended.

All private swimming pools shall be completely enclosed by a
fence at least four feet high and not more than six feet high. The
fence shall be a chain-link, stockade, picket (not exceeding four-inch
spacing) or solid wooden fence. Whether the pool is excavated or aboveground,
the fence shall be located at least three feet from the water's edge
on all sides. In all cases, any gate into the pool shall have a self-latching
lock which shall be placed at the top of the gate.

The maximum permissible size for private swimming pools in the
Borough of Hatfield shall be 35,000 gallons capacity.

It shall be unlawful to empty or drain private swimming pools
into the sanitary sewer system or into or upon the streets of the
Borough.

Water emptied or drained from private swimming pools must be
consumed on the property in such manner as will not constitute a nuisance,
or be emptied into the storm sewer system. Should the swimming pool
owner elect to drain into the storm sewer system, he shall be obliged
to install at his own cost and under the supervision of the Borough,
a connection from his pool into said storm sewer system.

All private swimming pools in the Borough must be equipped with
a filtering system, sufficient to maintain the purity of the water
in said swimming pool.

Anyone desiring to construct a private swimming pool in the
Borough of Hatfield shall make application for same on forms supplied
by the Borough, and shall accompany such application with complete
plans and specifications.

A fee, in an amount as established from time to time by resolution
of Borough Council, payable in advance, shall be made for each such
application.

Any person, firm or corporation who shall violate any provision
of this Part, upon conviction thereof in an action brought before
a Magisterial District Judge in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this Part continues
or each section of this Part which shall be found to have been violated
shall constitute a separate offense.

Outdoor lighting, if used at or around any pool, shall be installed
in such a way as to be shielded and not reflect toward adjacent residential
properties.

All electrical work connected with the pool and all equipment
connected thereto shall comply with all underwriters' regulations
and with the National Electrical Code and any other applicable International
Code or Codes and must be inspected and certified by an electrical
underwriter's inspection agency.
