The following terms used in this chapter shall have the following meanings:
ROLLER SKATES
A pair of devices normally worn on the feet with a set of wheels attached, regardless of the number or placement of those wheels, and used to glide or propel the user over the ground. Devices commonly known as "roller blades" are intended to be included within this definition.
SKATEBOARDS
A device made of material designed primarily to be stood upon, with a set of wheels attached, regardless of the number or placement of those wheels and used to glide or propel the user over the ground. It includes skateboards that are motorized.
No person shall operate or cause to be operated, skateboards, roller skates or roller blades or the like upon the following streets and adjacent sidewalks and curbs, as well as public or quasi-public areas, including but not limited to walkways, driveways, promenades and plazas on private property adjacent to these streets:

No person shall operate, or cause to be operated, skateboards, roller skates, roller blades or the like on any public park in the Borough, including, but not limited to, Count Basie Park, Eastside Park, Marine Park and Riverside Garden Park.
No person shall operate, or cause to be operated, skateboards, roller skates, roller blades or the like at the following additional locations in the Borough:
A. 
All public schools, including the administration building, middle school, charter school and primary school;
B. 
All municipal buildings and premises;
C. 
Riverview Hospital;
D. 
St. James Church and School;
E. 
Red Bank Catholic High School.
No person shall operate, or cause to be operated, skateboards, roller skates, roller blades or the like in a reckless or hazardous fashion or in a manner creating interference with pedestrian traffic, nor shall such person hold onto a motor vehicle or bicycle while such motor vehicle or bicycle is in motion.
No person under the age of 17 years shall operate or ride upon a skateboard, roller skates or roller blades on any property open to the public unless that person is wearing on his/her head a properly fitted and fastened bicycle helmet which meets the standards of the American National Standards Institute (ANSI Z90.4 bicycle helmet standard), the Snell Memorial Foundation's 1990 Standard for Protective Headgear for Use in Bicycling, or the American Society for Testing and Materials (ASTM) helmet standard.

Notwithstanding any other action which a law enforcement officer is authorized to take, upon probable cause to believe a minor has violated this chapter, the officer may escort the minor to police headquarters. As quickly as practical, the officer shall cause the minor's parent, guardian or other adult in the minor's household to be notified of the situation and shall request that the parent, guardian or other adult respond to headquarters to take custody of the minor.
A. 
Any person violating the provisions of this chapter shall, upon conviction, be subject to the penalties provided in Chapter 1, General Provisions, Article II, General Penalty.
B. 
A person who violates the provisions of § 571-7 by failing to wear an approved helmet shall be warned of the violation by the enforcing official. The parent or legal guardian of the violator may be fined a maximum of $25 for a first offense and a maximum of $100 for a subsequent offense. The penalties provided under the provisions of this subsection for failing to wear an approved helmet may be waived if the parent or legal guardian of the violator presents suitable proof that an approved helmet or appropriate personal protection equipment has been purchased since the violation occurred.
