The Emmaus Ambulance Corps has been established by Ord. 662 of 1985, comprised of ambulances, equipment and volunteers then existing, and any additional equipment or personnel which may be hereafter added, to provide adequate provisions for the transportation of the sick and injured to and from hospitals, asylums, medical centers or institutions where proper treatment may be administered; promoting the public health, safety, comfort and welfare of the citizens of the Borough of Emmaus and performing such other activities as may be designated by Borough Council; it shall consist of so many members as are authorized by Borough Council, including the following specifically enumerated officers: Chief, First Assistant Chief, Recording Secretary, Assistant Recording Secretary, Treasurer and three Lieutenants. The Emmaus Ambulance Corps is the official emergency medical service for the Borough of Emmaus and shall be dispatched on all medical emergencies in the Borough. The Emmaus Ambulance Corps shall decide when and if mutual aid is necessary.

As used in this Part, the following words and phrases shall have the following meanings, unless the content clearly indicates a different meaning:
AMBULANCE
A vehicle which is designed or intended to be used in providing transportation of wounded, injured, sick, invalid or incapacitated human beings, or expectant mothers.
ATTENDANT
A trained and qualified individual responsible for the operation of an ambulance and the care of the patients whether or not the attendant also serves as driver.
DISCIPLINE
The suspension or termination of a volunteer or paid employee of the Borough working under the direction of the Ambulance Chief.
EMPLOYEE
A person working part-time or full-time in any capacity under the direction of the Ambulance Chief and receiving pay from the Borough of Emmaus.
EMPLOYMENT POLICIES
Those policies adopted from time to time by the Borough Council of the Borough of Emmaus applicable to all non-civil service and non-public bargaining unit employees.

1. 
A Selection Committee composed of the General Administration Committee of the Borough of Emmaus and the current Ambulance Corps Chief will meet and recommend candidates to the Borough Council for those specifically enumerated officers positions set forth in § 1-601, except the Chief's position, which will be recommended for selection to the Borough Council by the General Administration Committee of the Borough of Emmaus. The appointing authority shall be the Borough Council of the Borough of Emmaus.

The Borough Council shall appoint officers for one-year terms to the positions of Chief, Assistant Chief, Recording Secretary, Assistant Recording Secretary, Treasurer and three Lieutenants. Officers of the Ambulance Corps serve as at-will employees and appointees. In the absence of the confirmation of a successor to a position, the person last designated shall continue to serve upon confirmation of Borough Council, for periods which may be one year or less than one year as determined by Borough Council. These persons may succeed themselves in their offices if reappointed by Council.

The Ambulance Corps shall be directed and supervised by the Chief whose duty it shall be to keep all ambulance equipment in order, to establish rules and regulations for the use and operation of the same for consideration and amendment or adoption by the Borough Council, and otherwise to accomplish the aims of this Part. The Chief shall make a report annually to the Borough Council by August, as to the conditions of the equipment and needs of the ambulance service. The Chief shall submit monthly reports and recommendations, including a financial report, and shall report recommendations for and the reasons for any discipline, including termination or suspension, to the Borough Council through the Borough Manager. The Chief shall be responsible for the proper training and discipline of the members of the ambulance service, and may suspend any member for refusal or neglect to obey orders pending final action by the Borough Council on his discharge or retention. The Chief, and in his or her absence the Assistant Chief, shall have the authority to recommend the necessary and appropriate purchases as established in the ambulance section of the annual Emmaus Borough Budget. All such purchases shall be made in full compliance with Borough ordinance and statutory requirements for bidding and purchases. The position of Ambulance Chief shall be one of full-time employment for the Borough of Emmaus and, as such, the Chief shall be paid a salary commensurate with the position as determined by the Borough Council.

It shall be the duty of the Chief to establish such practice sessions and give instruction in approved methods of emergency health care as the Chief, in his or her best judgment, deems appropriate, in compliance with the provisions of the Emergency Medical Services Act (35 P.S. § 6931 et seq., or subsequent amendments) and other applicable laws and Borough policies.

In the absence or disability of the Chief, the Assistant Chief shall perform all the functions and exercise all the authority of the Chief, the Borough Manger or the Borough Council.

The Chief shall annually establish a roster of active personnel, who, upon confirmation by the Borough Council following necessary background checks, certification of eligibility under applicable state statutes and driving record reviews, shall constitute the Ambulance Corps of the Borough of Emmaus. Members of the Ambulance Corps shall be governed by all employment policies and volunteer policies of the Borough governing conduct, duties and qualifications.
2. 
The personnel of the Ambulance Corps shall be under the direct supervisory control of the Chief. The Chief shall report to and be subject to the supervisory control of the Borough Manager, and the Borough Manager shall report to the Council.
3. 
Persons having attained the age of 16 years of age may become Corps personnel, subject to prevailing statutory law regarding age, duties, certification and qualifications.
4. 
The qualifications, training, duties and assignments of the Corps personnel shall be determined by the Constitution of the Corps, subject to compliance with the laws and codes of the Commonwealth of Pennsylvania and the policies of the Borough of Emmaus.
5. 
Upon severance from the Emmaus Ambulance Corps for any reason, either voluntary or involuntary, volunteers and paid employees shall return all clothing, coats, badges and insignias of rank or membership, electronic devices, medical equipment, handbooks, policy books, keys, pass cards and identification cards to the Ambulance Chief.

The Mayor, Police Officers of the Borough and members of the Ambulance Corps, Civil Defense Personnel or any of them, shall have authority in case of emergency to disperse all collections of idle or disorderly persons and otherwise to preserve order and to prevent the commission of offenses on such occasions; and to halt, divert or re-route traffic, and it shall be a violation for any person to fail to obey any order issued by authority of this section. Any person convicted of violating any provision of this section shall be fined not more than $300 for each offense, and costs of prosecution.

All Corps personnel of the Emmaus Ambulance Corps on duty at emergencies shall render direct obedience to the orders of the ranking officer as determined in § 1-601, supra, under the penalty of dismissal from active membership or termination of any paid position in the Emmaus Ambulance Corps for breach of discipline, lack of obedience to orders or for conduct unbecoming a Corps member. Rank to be determined as enumerated in § 1-601, supra. Actions in violation of mandatory medical protocols or which endanger the life of a patient may subject the member to immediate suspension with intent to terminate.

It shall be unlawful for any person to make, or cause to be made a call for ambulance service without probable cause, or to neglect to obey any reasonable order of a driver or attendants at an ambulance call, or to interfere with the ambulance service's discharge of its duties. Any person convicted of violating any provision of this section shall be fined not more than $300 for each offense, and costs of prosecution.

The Borough may, at any time, adopt such rules and regulations and standard operating procedures as it shall deem expedient for the government of the Ambulance Corps, and such rules and regulations shall be binding upon the Ambulance Corps and the members thereof.

The Chief, Recording Secretary, Assistant Recording Secretary, Treasurer and Lieutenants shall, before assuming office, take and subscribe the oath required of Borough officials.

The Emmaus Rescue Unit, comprised of truck, equipment and volunteers from the Emmaus Fire Department, and any additional equipment or manpower which may hereafter be recognized and now shall be called the Emmaus Rescue Squad.

The Rescue Squad of the Borough of Emmaus is established for the purpose of performing rescues, protecting the residents of the Borough, and performing such other activities as may be designated by proper Department authorities.

In addition to performing rescues inside or without the Borough, and traveling to and returning from such operations, the Rescue Squad and its members are authorized to answer any type call, inside or without the Borough of Emmaus, and to engage in any type of drill, training, ceremonial, practice, test, parade or other duty authorized by the Captain, or in his absence, by a duly authorized officer.

The officers of the Emmaus Rescue Squad shall consist of one Captain, three Lieutenants and one Head Driver and the same are hereby created and established.
2. 
The Captain, Lieutenants and Head Driver shall hold their offices for a two-year term, unless removed by the Fire Chief for just cause. They may succeed themselves in their offices, unless suspended by the Fire Chief.
3. 
It shall be the duty of the Captain or duly designated officers, to attend all rescues and alarms and superintend and direct the operation of the Rescue Squad. The Captain shall have full control of all the men and apparatus, issue and enforce such orders as in his judgment may be best calculated for the protection of property, the saving of lives and the welfare of the Department. He shall enforce all the rules and the regulations of the Department and the Borough Ordinances pertaining thereto. He shall at the end of each fiscal year report to Fire Chief a full statement of all rescues occurring during the year, the origin of same, property destroyed and insurance thereon, if any. If he shall be absent from the Borough, he shall designate an officer of the squad to act during his absence.
4. 
The Captain may delegate to the Lieutenants any of the aforementioned duties.
5. 
Lieutenants shall answer all alarms of rescue by proceeding to the rescue or fire station according to orders of the Captain. The first officer arriving at a rescue shall have charge until the arrival of the Captain.
6. 
The Captain shall have charge of the conduct of the Rescue Squad. In the absence of the Captain from the Borough, the officer designated by him to act in his stead shall be recognized as the head of the Squad.
7. 
The Rescue Squad shall at all times be under the jurisdiction and authority of the Fire Chief.

The Captain shall annually establish a roster of active rescue personnel who shall constitute the Rescue Squad of the Borough of Emmaus.
2. 
The rescue personnel of the Rescue Squad shall be under the control and jurisdiction of the Captain.
3. 
Persons from 16 to 45 years of age, inclusive, may become rescue personnel.
The qualifications, training, duties and assignments of the rescue personnel shall be as determined by the Captain, subject to any restrictions by laws.

The officers of the Rescue Squad shall include:

The officers of the Rescue Squad shall be elected biannually, to take office on the first Monday in January commencing with the even number years. All such officers shall be elected subject to the approval of the Fire Chief, and the approval of the Borough Council.
3. 
Squad officers must be on the active roster of the Emmaus Rescue Squad § 1-625(1) of this Part.
4. 
Voting for Squad Officers shall be confined to active members of the Emmaus Rescue Squad.

All rescue personnel of the Emmaus Rescue Squad of Borough of Emmaus on duty at emergencies shall render implicit obedience to the orders of the Captain or officers under the penalty of dismissal from active membership in the Emmaus Rescue Squad for a breach of discipline, lack of obedience to orders or for conduct unbecoming a Squad member.

Any member suspended or dismissed by the Captain may appeal from such decision to the Fire Chief. If the suspended or dismissed member is dissatisfied with the decision of the Fire Chief, he may appeal to a trial committee which shall be composed of the members of the Fire Committee of Borough Council of the Borough of Emmaus, who, after investigating and hearing the appeal, may sustain the action of the Captain or overrule the same and reinstate the dismissed member to full membership in the Squad.
