1. The Emmaus Public Library is hereby authorized and designated to
act as the legal agent of the Borough of Emmaus to provide public
library service to the residents and taxpayers of the Borough for
and on behalf of the Borough of Emmaus.
2. Borough agrees to maintain or assist in the maintenance of the Emmaus
Public Library in accordance with the provisions of Section 401, of
the Library Code, Act of June 14, 1961, P.L. 324.
3. The Emmaus Public Library shall be operated by a Library Board of
Directors consisting of nine people to be appointed in accordance
with Section 411 et seq., of the Library Code, supra, in the following
manner:
A. Six people to be appointed by the Borough Council of Emmaus.
B. One person to be appointed by the Borough of Macungie.
C. Two persons to be appointed by the Township of Upper Milford.
Each representative to serve for a term of three years beginning
on May 1, 1965; provided that of the first appointees two Directors
shall be appointed for terms expiring December 31, 1966, and three
members shall be appointed for terms expiring December 31, 1967. All
appointments to fill the places of those Directors whose terms expire
shall be for a term of three years. Vacancies shall be filled for
the unexpired terms and shall be filled by appointment of the municipality
sponsoring the vacated position within two months of said vacancy
occurring. No member of the Board of Directors shall receive any salary
for his service as such.
4. The Board of Library Directors shall organize as soon as may be after
appointment by electing a President, Secretary, and Treasurer from
its membership and such other officers and agents as the Board may
deem necessary. The Treasurer shall give bond to the Borough of Emmaus
with satisfactory surety in such amount as the Board of Directors
of the library may determine in accord with Section 412 of the Library
Code supra.
5. The Council of the Borough of Emmaus shall make an annual appropriation
out of its general budget, or from a special tax levy, if so desired
by it, to maintain or assist in the maintenance of the Emmaus Public
Library.
6. All moneys appropriated for the establishment and/or maintenance
of a local library and all moneys, if any, received from other sources
for its use, shall be disbursed under the direction of the Board of
Library Directors.
7. The Board of Directors of the library shall make a report annually,
to Council of the Borough of Emmaus, of the moneys received by such
library and the disposition made thereof, and Borough Council shall
arrange to have the accounts of the Treasurer of the Board of Directors
of the library audited annually as in the case of other municipal
expenditures.
8. The Board of Directors of the library shall prepare and present to
the Borough Council and to the State Library in Harrisburg such annual
reports as are required by Section 414 of the Library Code, supra.
9. The Board of Directors of the library shall give free library service
to the residents and taxpayers, subject to such reasonable rules and
regulations as the Board of Library Directors may adopt, and the Board
may exclude from the library any person who wilfully violates such
rules, all as provided in Section 415 of the Library Code, supra.
