Hereafter it shall be unlawful to plant or maintain any Carolina Poplar Tree or Callery Pear Tree within the right-of-way of any public street of the Borough of Aspinwall.

All Carolina Poplar Trees and Callery Pear Trees now existing within any public street in the Borough are hereby declared to be, individually and collectively, a public nuisance, and if after 30 days' notice the owner of any property abutting thereon shall fail to cut down or remove such tree or trees, the work shall be done by the Borough and the cost paid by the property owner together with a penalty equaling 10% of the cost of the tree removal.

The provisions of this section shall apply as well to any tree causing or liable to cause damage to any public sewer, water line, pavement or other public improvement or obstructing the proper use of a public street by the public.

The planting, trimming or removal of any Shade Tree in the Borough shall require prior written approval of the Shade Tree Commission pursuant to Chapter 1, Part 4C, of the Aspinwall Borough Code of Ordinances, Shade Tree Commission, as amended.

Any person, firm or corporation who violates a provision of this Part, or who fails to comply therewith, or with any of the requirements thereof, shall be, upon conviction thereof, sentenced to pay a fine of not less than $100 nor more than $600 for each violation, plus costs, and in default of payment of said fine and costs, to imprisonment to the extent permitted by law for the punishment of summary offenses.
2. 
A separate offense shall arise for each day or portion thereof in which a violation is found to exist or for each section of this Part found to have been violated. All fines and penalties for the violation of this Part shall be paid to the Borough Treasurer.
3. 
The Borough may also commence appropriate actions in equity or other to prevent, restrain, correct, enjoin, or abate violations of this Part.
