GENERAL REFERENCES
Construction standards — See Ch. 215.
For the purpose of this chapter, the following terms, phrases, words, and their derivations shall have the meaning given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number, and words in the singular number include the plural number. The word "shall" is always mandatory and not merely directory.
BUILDING
A structure designed, built or occupied as a shelter or roofed enclosure for persons, animals or property and used for residential, business, mercantile, storage, commercial, industrial, institutional, assembly, educational or recreational purposes.
BUILDING INSPECTOR
The Building Inspector for Huron Township or his duly authorized representative.
BUILDING OFFICIAL
The Building Official for Huron Township.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
SUPERVISOR
The Supervisor of Huron Township.
TOWNSHIP
The Township of Huron.[1]

No person shall move any building over, along or across any highway, street or alley in the Township without first obtaining a permit therefor.
A. 
The Building Inspector shall issue no permit for the moving of any building from any part of Huron Township to another, or from any area outside of Huron Township to any location within Huron Township, except as specified in this chapter.
B. 
Exception. No permit is required for premanufactured buildings which are being moved from place of original construction to a site within the Township.
Any person desiring to move any building from any point in Huron Township to another, or from any area outside of Huron Township to any location within Huron Township, shall make application, in writing, to the Township Building Department. The application shall be forwarded to Building Official, who shall inspect the building to be moved and the area it is to be moved upon. After this inspection, a preliminary determination shall be made by the Building Official as to whether the moving request will comply with this chapter. The Building Department shall then notify the applicant of this determination, in writing. The Building Official shall find that the following conditions exist in addition to any other provisions or requirements of this chapter and any other ordinances of the Township of Huron prior to making a favorable determination.
A. 
That the building is structurally sound and can be safely moved to its new location;
B. 
That the building can be conditioned to comply with applicable Township ordinances, building codes and state housing code;
C. 
That the building can be conditioned so as to serve the use and occupancy for which it is intended;
D. 
That the building will be similar in character to the buildings in the area where it is to be moved.

Applications for a permit shall be made upon forms prescribed by the Building Department, together with an application fee established by the Township Board. In the event the preliminary determination, as provided for in § 165-3, is unfavorable, the Township shall refund such portion of the application fee remaining, if any, after deducting reasonable costs and expenses, including administrative costs, incurred by the Township for such preliminary determination.
(This section does not apply if the structure is being moved out of the Township.) As part of the application, applicant must furnish the following information:
A. 
A plan view drawing, the size of which shall be not less than 11 inches by 17 inches, showing the lot or lots to which the proposed building will be moved, the lot number or numbers, the legal description of same and the plat name or number.
B. 
The location and size of the proposed building to be moved in relation to the lot boundaries, drawn to scale.
C. 
Any proposed changes, additions or deletions, drawn to scale, relative to the lot boundaries.
D. 
Location of all windows, exterior doors, stoops, steps, porches, breezeways, garages, and exterior chimneys.
E. 
All exterior dimensions, except windows and doors.
F. 
The number of square feet of the living quarters only, of the building, before moving and after the additions and deletions are made. A one-story building must show the footage on the ground floor, a two-story building must show the footage on the ground floor and on the second floor. In no case shall a breezeway or utility room be considered as living quarters. Square footage shall be computed as per the Township building code or ordinance.
G. 
If a basement is to be constructed under the building, then a separate plan view drawing shall be submitted, the size of which shall be not less than 11 inches by 17 inches, showing the proposed completed floor plan in outline with the location of the basement, drawn to scale, relative to the structure as proposed; the dimensions of the basement, the height after completion and type of floor.
H. 
A separate elevation drawing, the size of which shall be not less than 11 inches by 17 inches, showing the exterior of the completed structure, front view, side view, and rear view, drawn to scale, also showing the building height by measurement, from the ground level to the highest roof line.
I. 
The drawing as required shall not be a freehand sketch, but shall be well laid out, clearly defined and done in a good workmanlike manner.
J. 
Any landscaping shown on any drawing submitted shall become mandatory as part of the condition by which this permit shall be granted.
As part of the application, the applicant must furnish the following information pertaining to the proposed building as it exists before moving:
A. 
Whether the building is a one-story or a two-story structure. If one-story, the number of square feet comprising the living quarters only of the ground floor. If a two-story structure, the total number of square feet comprising the living quarters of both floors.
B. 
If a garage is attached, whether attached directly to the main structure or by a breezeway, with exterior dimensions of both.
C. 
Outside dimensions of structure to be moved, excluding attached garage or breezeway, including height to highest roof line.
D. 
Type and condition of exterior.
E. 
Number, size, type and condition of windows.
F. 
Type and condition of roof.
G. 
The number, type and height above roof line of chimneys.
H. 
Satisfactory evidence that the building and lot from which it is to be removed are free of all liens and that all taxes and any charges or assessments against the same are paid in full.
I. 
If the applicant is other than the owner, a written statement or bill of sale signed by the owner, or other satisfactory evidence that the applicant is entitled to move the building.
Within five days after receipt of an application in proper form, the Building Inspector shall submit one copy of all papers, drawings, application form and other pertinent information through the Supervisor to the Building Official.

Any errors whatsoever, typographical or otherwise, whether intentional or not, in any application, drawing, description, papers or any information pertinent to this chapter, which in any way change the meaning of the application submitted to obtain a permit, make the complete application null and void.
Within 15 days after the application is filed, the Building Inspector and Building Official shall make a personal inspection of the proposed building to be moved and the proposed actual site that the building is to be moved upon. The Building Inspector and Building Official may make this inspection collectively or separately.

If a garage is attached to the building to be moved, either by a breezeway or directly to the building, then such garage and breezeway may be considered as part of the building to be moved. If a garage or any additional building supplemental to the main dwelling is not attached directly thereto or by a breezeway, the same will not be considered as part of the building included within the application.
Any building, before and after being moved, must comply with Chapter 530, Zoning, and all building, plumbing, heating, electrical ordinances or codes, and all state, county, Township health ordinances or codes or be able to be modified in order to meet these codes.
After the Building Official and Building Inspector have inspected both the building to be moved and the proposed site, the Building Inspector and the Building Official shall meet and determine if the building can be moved.

If, at such meeting, the Building Inspector and Building Official decide that the applicant has satisfied all the requirements of this chapter, and that the issuance of the moving permit would not be detrimental to the Township, the Building Inspector shall issue such house-moving permit, which shall automatically expire 90 days after issuance.

A condition of such permit shall be that, within 10 days after issuance, the applicant shall file a performance bond for the improvements as specified in the application, in such amount as the Building Inspector deems necessary to cover all costs involved, including the removal of any debris and the filling of any excavations incurred as a result of said moving within the Township, and also for any damages that may have been incurred in connection with said moving operation.
The permittee shall, in addition to the other requirements of this chapter, do the following:
A. 
Notify the Building Inspector in writing of the moving date, time, the route and method to be used in moving said building.
B. 
Notify the Building Inspector in writing of any desired change in the moving date and hours as proposed in Subsection A of this section.
C. 
Notify the Building Inspector in writing of any and all damage to property caused by the moving within 24 hours after the damage or injury has occurred.
D. 
Remove all rubbish, building materials and debris, and fill all excavations to existing grade at the original building site, so that the premises are left in a safe and sanitary condition if the site is within the Township.
Any person who shall violate the provisions of this chapter shall be punished by a fine not to exceed $500 or by imprisonment for a term not to exceed 90 days, or by both such fine and imprisonment.
