There is hereby created a Department of Public Works within
the City of Kimberling City, Missouri.

The Department of Public Works shall consist of a City Engineer who shall oversee the budget, development, construction and maintenance of the City's streets, municipal buildings lighting system, water system, sanitary sewer, solid waste disposal, storm drainage, etc., in accordance with Section 115.190 of this Code. As needed, the sewer plant operator, Building Inspector, City crew, etc., shall be employed under supervision of the City Engineer.

Employees of the Department of Public Works shall follow and
adhere to the labor rules set forth in the Fair Labor Standards Act
of 1938, as amended (see 29 U.S.C. § 201 et seq.).

The Committee shall elect its Chairman, Vice Chairman, and Secretary
from among the citizen members. The term of the Chairman, Vice Chairman,
and Secretary shall each be for one (1) year, with eligibility for
reelection.

The Committee shall hold a regular meeting each month, or as
requested by the Board of Aldermen or as often as said Committee may
require. Special meetings may be called at anytime by the Mayor, the
City Engineer, or by the Chairman of the Committee.

The Committee shall adopt rules for the transaction of business
and keep a record of its proceedings. These records shall be public
records.

The Committee shall expend monies within the amounts appropriated
for the purpose by the Board of Aldermen (exclusive of grants and
gifts). The Committee shall request that the Board of Aldermen appoint
the employees and staff necessary for its work, subject to above monetary
limitations, and the Committee shall recommend any contracts with
City planners and other persons for the services or equipment that
it requires, also subject to the above monetary limitations. The Committee
shall not expend any monies, employ any personnel or enter into any
contracts of any nature without prior approval of the Board of Aldermen.

The Committee will work with the City Engineer and shall make
reports and recommendations relating to the development, construction
and maintenance of City roads, streets, electrical system, water system,
sanitary sewer, solid waste disposal, storm drainage, and the budget
for same. It shall recommend to the Board of Aldermen, the City Engineer
and the Mayor, programs for such public improvements and the financing
thereof. All public officials shall, upon request, furnish to the
Committee within a reasonable time, all available information it requires
for its work. The Committee, its members and employees, in the performance
of its functions, may enter upon any land to make examinations and
surveys. In general, the Committee shall have the power necessary
to enable it to perform its functions but shall not usurp or exercise
any of the powers of the City Engineer concerning the direct supervision
of maintenance or construction employees and/or contractors. Any such
disagreement or differences of opinion between the City Engineer and
the Committee concerning such matters shall be referred to the Mayor
and Board of Aldermen for resolution.

The Committee shall not recommend to lay out, open, improve,
grade, pave or light any street within the City unless the street
corresponds in its location and aligns with a street shown on a subdivision
plat approved by the Board of Aldermen or a street plan made and adopted
by the Planning and Zoning Commission. Recommended work on any such
street must be first submitted to the Planning and Zoning Commission
for its approval, or if disapproved, then by the affirmative vote
of not less than two-thirds (2/3) of the entire membership of the
Board of Aldermen.

The acceptance, widening, removal, extension, relocation, narrowing,
vacation, abandonment, change of use, or acquisition of land, or sale
or lease of any City road or street shall be submitted to the Planning
and Zoning Commission for its approval. In case of disapproval the
Planning and Zoning Commission shall communicate its reasons to the
Committee and to the Board of Aldermen and said Board, by vote of
not less than two-thirds (2/3) of its entire membership, may overrule
the disapproval, and upon an overruling by the Board of Aldermen,
the Committee may proceed.

The Planning and Zoning Commission shall refer any and all requested
changes or amendments of the major street plan to the Committee for
its consideration and recommendations prior to submission of any such
changes or amendments of said street plan to the Board of Aldermen.
