As used in this chapter, the following terms shall have the meanings indicated:
PORTABLE STORAGE UNIT
Portable containers designed, intended or used for the storage of household goods and other personal property and placed outdoors on residential property, such as PODS.
The placement and maintenance of a portable storage unit on residential property is prohibited without a permit from the Lysander Codes Enforcement Office. A written application and a fee of $10 for each permit or permit extension will be required. The property owner shall give written consent to any application by a tenant or other occupant of the property where the portable storage unit is to be placed.
Permits will be granted by the Codes Enforcement Office to the owner, tenant or other occupant of property for the placement of a portable storage unit for a period of 30 days. One extension for an additional 30 days will be granted upon request. Any additional extension shall be granted by the Town Board only upon a determination that good cause has been demonstrated.
Only one portable storage unit may be placed upon any residential property at one time. Portable storage units shall not have a footprint exceeding 130 square feet or a height of more than eight feet. Portable storage units shall not be placed forward of the front line of the principal residential structure on the lot, except in a driveway, and then as far from the street as practicable. Portable storage units shall be set back at least five feet from any boundary line and at least five feet from any structure. The Codes Enforcement Officer is empowered to approve the location of the portable storage unit if there is no driveway, if the location is on a corner lot, or under circumstances where the rights of neighboring property owners may be adversely affected.
