This chapter applies to the burial of deceased persons within
the Township of Blair, Blair County, Pennsylvania, by any person,
firm, corporation, or other entity owning or occupying property within
the Township of Blair, Blair County, Pennsylvania.

No person, firm, corporation, or other entity owning or occupying
any property within the Township of Blair shall bury, inter, or knowingly
allow or permit the burial or interment of a deceased person in or
on land within the Township of Blair unless said burial or interment
is in or on land currently used as a cemetery or formally recognized
burial ground within the geographical limits of the Township of Blair.

Any person who violates or permits a violation of this chapter
shall, upon being found liable therefor in a civil enforcement proceeding
commenced by the Township before a Magisterial District Judge, pay
a fine of not more than $600, plus all court costs, including reasonable
attorneys’ fees, incurred by the Township in the enforcement
of this chapter. No judgment shall be imposed until the date of the
determination of the violation by the Magisterial District Judge.
If the defendant neither pays nor timely appeals the judgment, the
Township may enforce the judgment pursuant to the applicable Rules
of Civil Procedure. Each day a violation exists shall constitute a
separate offense. Further, the appropriate officers or agents of the
Township are hereby authorized to seek equitable relief, including
injunction, to enforce compliance herewith. The imposition of a fine
or other penalty for any violation of or noncompliance with this chapter
shall not excuse the violation or noncompliance or permit the same
to continue. All violations and noncompliances of this chapter must
be remedied and corrected within 30 days after a citation is issued
for a violation of this chapter.
