It is hereby declared to be the intention and purpose of this
Part to establish standards for connections to the Spring-Benner Joint
Authority (the authority) and to bring its standards into conformity
with other municipalities in the Centre Region, in order to protect,
benefit and preserve the health, safety and welfare of the inhabitants
of this Township.

This Part shall be known as the "Building Sewers Standards Ordinance."

1.
Building sewers and building drains shall be constructed in accordance
with those sections of the BOCA Basic Plumbing Code, Fourth Edition
1978, pertaining to building sewers and building drains, which are
incorporated herein by reference and which are specifically enumerated
as sections in each article as follows:

1.
The following subsections of the BOCA Code are hereby amended to
read as follows:
A.
Section P-103.0 Existing Plumbing Terms.
§ P-103.1 Application. This code shall apply to all
sanitary sewage and waste drainage systems for all properties to be
served by the Spring-Benner Joint Authority sanitary sewer system.
B.
LATERAL
WASTEWATER
Section P-201 Definitions and Plumbing Terms. The following definitions
are added to this section:
The sanitary sewer pipe that is located within a street,
road as right-of-way and extends from the main collection sewer to
the property line of the building to be served by the sanitary sewer
system or that extends to a point approximately three feet beyond
the edge of sidewalk or edge of the paved road or shoulder towards
said building to be served.
The spent water of a building or community from a building
or community. From the standpoint of source, it may be a combination
of the liquid and water-carried wastes from residences, commercial
buildings, industrial plants and institutions.
C.
Section P-303.0 Connection to Public Water and Sewer System.
§ P-303.2 Public Systems Available. The public sewer
system shall be deemed available to premises used for human occupancy
if such premises are within 150 feet measured from the nearest point
of said building to the potential point of connection to the sanitary
sewer system. The lateral installed or to be installed by the authority
shall be considered an integral part of the sanitary sewer system.
A connection conforming with the standards set forth in this code
shall be made between the owner's house sewer and the authority's
lateral with the costs of making such connection to be paid by the
owner of the property.
D.
Section P-308.0 Protection of Pipes.
§ P-308.3 Freezing. Sewers shall be installed below
recorded frost penetration but not less than three feet, six inches
below grade. Plumbing piping in exterior building walls shall be adequately
protected against freezing by insulation or heat or both.
E.
Section P-309.0 Sleeves.
§ P-309.1 Exterior Walls. In exterior walls a steel
sleeve may be used to provide for an opening where the house sewer
passes through the foundation, footer or basement wall. The annular
space between the sleeve and pipe may be sealed using a rubber wall
seal which utilizes bolts to expand the rubber thereby sealing the
space between the sewer pipe and sleeve. The annular space may also
be tightly caulked with coal tar, asphaltum compound or grout. Seal
rings which are expanded by injection of a gel material which hardens
may also be used.
F.
Section P-450.0 Piping System Materials.
§ P-405.2.2 Underground Building Drains (Sanitary
and Storm). The underground building sanitary sewer (house sewer)
shall be not less than four inch diameter or it may also be five inch
or six diameter. Eight inch sewers will be permitted only upon approval
of the authority. Acceptable specifications for house sewers are listed
below:

1.
The following requirements or standards are adopted in addition to
those set forth in those sections of the BOCA Basic Plumbing Code
as adopted and amended above:
A.
No two properties shall use the same building sewer or other sewer
which is part of the building sewer.
B.
If it is necessary for house sewer to cross private property in order
to connect to the sanitary sewer system, then the owner of the property
who plans to cross private property shall present a copy of the written
agreement between the parties providing for such private right-of-way
crossing and the agreement shall also bind the parties thereto, their
heirs, successors and assigns.

The Spring-Benner Joint Authority shall appoint a Plumbing Official
charged with the administration and enforcement of this Part.

The Board of Supervisors of Spring or Benner Townships may grant
a variance or variances from the strict requirements of this Part
upon application in writing by a landowner or his agent. A variance
shall be granted where it can be shown by the applicant that, because
of physical circumstances or conditions, strict conformity with the
requirement of this Part would cause unnecessary hardship and that
the fundamental purposes of this Part can be fulfilled in another
reasonably sound manner. Prior to the granting of any variance, a
copy of the application shall be sent to the office of the Spring-Benner
Joint Authority for review and comment. Said authority and the applicant
shall be notified by mail of the date and time of the Supervisors'
meeting at which said application shall be considered.

Any person, firm or corporation who shall violate any provisions
of this Part, upon conviction thereof in an action brought before
a district justice in the manner provided for the enforcement of summary
offenses under the Pennsylvania Rules of Criminal Procedure, shall
be sentenced to pay a fine of not more than $1,000 plus costs and,
in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this part continues
or each section of this part which shall be found to have been violated
shall constitute a separate offense.

The imposition of the penalties herein prescribed shall not
preclude the institution of appropriate actions at law or equity to
prevent unlawful construction or to restrain, correct or abate a violation,
or to prevent illegal occupancy of a building structure or premises,
or to stop an illegal act, conduct, business or use of a building
or structure in or about any premises.
