This Part shall be known and may be cited as the "Manchester Township Water District No. 2 Ordinance."

To provide for the public health, safety and welfare, the Supervisors of Manchester Township, York County, Pennsylvania are hereby authorized and empowered to enter into an agreement with the York Water Company and others for the purposes of creating a water district in which there will he installed public water mains for public water service. The water district shall be called the "Manchester Township Water District No. 2" and shall encompass the following areas of the Township:
From the point of intersection of the Manchester, Springettsbury and East Manchester Township lines, northerly along the East Manchester Township line approximately 2,700 feet; thence southwest to the northeast corner of the York County Industrial Park; thence generally westerly to Church Road along existing property lines; thence northerly along Church Road to the railroad right-of-way; thence southerly along the railroad right-of-way to Locust Lane; thence along Locust Lane crossing Emig Road; thence northerly along existing lot lines to the Springettsbury Township line; thence northerly and easterly along the Springettsbury Township line to the point of beginning; being that area more fully defined and described on a map of said district included as Exhibit A and incorporated herein by reference.[1]

All persons owning any building now erected within the Manchester Township Water District No. 2 that is occupied or intended for human or animal habitation and is accessible to the public water system, and all persons hereafter erecting any new building within the district that is intended for human habitation or occupancy and is accessible to the public water system, shall, at their own expense, make connection of such building to the public water system. A building shall be deemed "accessible" to the public water system within Water District No. 2 when any part of the parcel(s) on which it is located is adjacent to any public street or easement in which is laid a public water main.

All connections to the public water system shall be made in accordance with the applicable Township ordinances then in effect and the rules and regulations thereunder and in accordance with the rules, regulations and specifications from time to time in effect and specified in the York Water Company's tariffs and operating policies and the rules and regulations thereunder and in accordance with the rules, regulations and specifications from time to time in effect and specified in the York Water Company's "Rates, Rules and Regulations," hereinafter "York Water Rules."

Upon the connection of any building to the public water system, the internal water and plumbing system or such building connected to any individual on-lot or private water system shall be immediately disconnected and the on-site water wells properly abandoned, except as allowed pursuant to Subsection 1A below:

Existing on-lot or private water systems may, with the approval of the Pennsylvania Department of Environmental Protection and the York Water Company, be maintained and used for irrigation, fire protection, or other industrial purposes not prohibited by said company's operation policies. In no event shall there be any cross-connection of any on-lot or private water system with the system supplied by the public water system.

Each person making application for public water service may be required to pay a connection fee for each building required to be connected. Applicants shall be classified as residential, commercial or industrial, as specified in the Customer Classification Guidelines of the York Water Company from time to time in effect. Any such connection fees hereby imposed shall be payable to the York Water Company pursuant to the York Water Rules.

Any person who shall connect a building to the public water system shall thereafter be responsible to pay the York Water Company for such service at its rates in effect for such service.

The Township, in its agreement with the York Water Company, has designated the company as its agent to do and perform certain acts for the Township regarding the Manchester Township water districts. Wherever the York Water Company is so designated, either expressly or by implication in the agreement or this Part, the said company is hereby authorized to act, subject to the terms and provisions of the agreement and this Part.

Any person who shall fail or refuse to perform any act, duty or obligation imposed by this Part shall, upon conviction thereof, be fined not more than $600 and costs of prosecution and, in default of payment thereof, shall be imprisoned for not more than 30 days. A separate offense shall be deemed committed on each day during or on which a violation or failure to comply occurs or continues.

At least 90 days prior to any amendment, repeal or abolition of this Part, notice of such amendment, repeal or abolition shall be provided to the Pennsylvania Department of Environmental Protection, South-Central Regional Office, Bureau of Environmental Cleanup and Brownfields, 900 Elmerton Avenue, Harrisburg, Pennsylvania 17110.
