1. Unless otherwise specified herein, the maximum speed limit established
by the Pennsylvania Vehicle Code shall apply on any street within
the Township boundaries. The following maximum speed limits are established
on the streets or parts of streets specified below, and it shall be
unlawful for any person to drive a vehicle at a higher speed than
the maximum speed limit prescribed for that part of the street:

2. Any person who violates any provision of this section, upon conviction,
shall be sentenced to pay a fine of $35 and costs. Any person exceeding
the maximum speed limit by more than five miles per hour shall pay
an additional fine of $2 per mile for each mile in excess of five
miles per hour over the maximum speed limit.

2. Any driver of a vehicle who disobeys the directions of any traffic
signal, upon conviction, shall be sentenced to pay a fine of $25 and
costs.

2. Any person who violates any provision of this section, upon conviction,

1. The following intersections are established as stop intersections,
and official stop signs shall be erected (or are ratified if previously
erected) in such a position as to face traffic approaching the second-named
street (the intersecting or through street) on the first-named street
(the stop street) in the direction or directions indicated for that
intersection. Every driver of a vehicle approaching the intersection
on the first-named street (the stop street), in the direction indicated
in each case, shall stop the vehicle as required by the Vehicle Code,
75 Pa.C.S.A. § 3323(b), and shall not proceed into or across
the second-named street (the intersecting or through street) until
said driver has followed all applicable requirements of that section
of the law.

1. The following intersections and locations are established as yield
intersections and locations, and official yield signs shall be erected
(or are ratified if previously erected) in such a position as to face
traffic on the first-named street the yield street) approaching the
second-named street or location (the through street or location) in
the direction or directions indicated for that intersection or location.
Every driver of a vehicle approaching the intersection or location
on the first-named street (the yield street), in the direction indicated
in each case, shall slow down or stop the vehicle as required by 75
Pa.C.S.A. § 3323(c) of the Vehicle Code, and then yield
the right-of-way as required by that subsection of the Vehicle Code.

2. Any person who violates any provision of this section, upon conviction,

1. No motor vehicle including a motorcycle, pedalcycle or minibike shall
be operated on any property owned by the Township or any other public
agency or instrumentality within the Township without the permission
of the property owner and a permit from the Township.

shall be sentenced to pay a fine of $25 and costs.

1. Findings. The Board of Commissioners of the Township of Lower Macungie
finds as a fact that the operation of an engine brake retarder on
a gasoline-powered or diesel-powered motor vehicle upon certain streets
within the Township, as more specifically set forth herein, creates
excessive noise through the use of said engine brake retarder, thereby
adversely affecting the public health, safety and welfare of the residents
of the Township of Lower Macungie Township.
2. Prohibitions. No gasoline-powered or diesel-powered motor vehicles shall be operated on the streets, roads, alleys or highways listed below in Subsection
3 within the Township of Lower Macungie Township, Lehigh County, Pennsylvania, utilizing, in said operation, an engine brake retarder.
3. Streets. The streets subject to this prohibition shall be as follows:
A. All of Route 100 northbound falling within the Lower Macungie Township
boundaries.
B. All of Route 100 southbound falling within the Lower Macungie Township
boundaries.
C. Trexlertown Road, between Spring Creek Road and the Upper Macungie
Township Municipal Line.

4. Emergency Situations. This section shall not apply to emergency driving
situations requiring the utilization of an engine brake retarder to
protect the safety and property of the residents of Lower Macungie
Township, other motor vehicle operators, pedestrians, and the operator
and passengers of the motor vehicle involved in said emergency situation.
The deployment of such emergency braking shall in no way be an excuse
for violating the Motor Vehicle Code.
5. Penalty. Any person, firm, corporation or organization violating
any of the provisions of this section shall, upon summary conviction
before a District Magistrate having jurisdiction, be sentenced to
pay a fine of not less than $100 or more than $300, and costs of prosecution,
and may be sentenced to undergo imprisonment in Lehigh County Prison
for a period of time as may permitted by law.
