1. DEP or its designees (e.g., County Conservation District) normally
ensure compliance with any permits issued, including those for stormwater
management. In addition to DEP compliance programs, the municipality
or its designee may inspect all phases of the construction, operations,
maintenance and any other implementation of stormwater BMPs.
2. During any stage of the regulated earth disturbance activities, if the municipality or its designee determines that any BMPs are not being implemented in accordance with this Chapter
23A, the municipality may suspend or revoke any existing permits or other approvals issued by the municipality until the deficiencies are corrected.
3. The landowner or owner's designee (including the Township for dedicated and owned facilities) shall inspect stormwater management BMPs, facilities and/or structures installed under this Chapter
23A according to the following minimum frequencies, to ensure the stormwater management BMPs, facilities and/or structures continue to function as intended:

A. Annually
for the first five years.
B. Once
every three years thereafter.
C. During
or immediately after the cessation of a ten-year or greater storm.
4. Inspections
should be conducted during or immediately following precipitation
events. A written inspection report shall be created to document each
inspection. The inspection report shall contain the date and time
of the inspection, the individuals who completed the inspection, the
location of the stormwater management BMP, facility or structure inspected,
observations on performance, and recommendations for improving performance,
if applicable. Inspection reports shall be submitted to the Township
within 30 days following the completion of the inspection.
