From and after the adoption of this article, it shall be unlawful
for any person to keep or maintain any public pool or billiard room
for hire and public amusement equipment including, but not limited
to, pinball machines, shooting galleries, bowling machines, computer
games, video games and all other similar devices, coin- or token-operated
and automatic unless a license as hereinafter provided shall have
been obtained.
Said license shall be issued by the Chief of Police and shall
be for a period of one year. The application for license shall contain
the following information:
A. The name and address of the applicant or applicants.
B. The address of the premises for which the license is desired and
a detailed description of the tables, machines, equipment, including
the number thereof, to be maintained and operated therein.
C. The name of the owner of the premises.
D. At the time of filing the application, the applicant shall pay to
the Borough of Dalton a one-time fee set pursuant to resolution of
the Dalton Borough Council.
If said license is granted, it shall not, under any circumstances, be transferable to any other premises or any other person or person during the year for which it is granted. The fee for a license issued under this article shall be as set pursuant to a resolution of the Borough Council per device as described in §
139-1 and is payable to the Borough of Dalton prior to the issuance of the said license and is nonrefundable. The license will be renewed annually upon payment of an additional license fee as set by the Borough Council per device. No additional devices shall be installed, used or maintained without proper license.
All licensed devices shall be subject to reasonable inspection
by Borough Police to determine if it poses a threat to the health
safety, morals, and general welfare to the people of the Borough of
Dalton.
Any person who violates this article shall, upon being found
liable therefor, pay a fine of not more than $600, plus court costs
and reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings.
