The regulations set forth in §
92-3 of this chapter shall regulate the conduct of persons as individuals or as groups of persons and govern their use of the public park and recreation area. The Township Committee may amend or add to these regulations as it sees fit.
As used in these regulations, the following terms shall have
the meanings indicated:
PROPER AUTHORITY
The Township Committee or its empowered designee by delegation
of authority, which delegation may be by resolution of the Township
Committee.
No person or group of persons, while in or upon the recreation
area, shall:
A. Be in or upon the recreation area for any purpose during the hours
of closing for said areas, except for authorized persons while in
the performance of official duties.
B. Damage, deface, injure, destroy, displace or remove any buildings,
benches, tables, paving, signs, notices, monuments, trees, shrubs,
plants, stakes, boundary markers, utilities of other structures or
equipment, facilities or appurtenances whatsoever, except in the maintenance
of said property by authorized persons.
C. Construct or erect any tent, building or other structure of whatever
kind, whether permanent or temporary, or run or string lines, wires
or other lines upon or across such lands, except upon written permission
by the Township Committee or its designee.
D. Hunt, pursue, shoot, harm, trap or kill any animal or wildlife found upon such lands. (See Code Chapter
49.)
E. Bring in or dump upon, deposit or leave upon the recreation area any bottles, broken glass, trash, garbage or other refuse. Any refuse generated in connection with the proper use of the property must be placed in the proper receptacles where provided for such matters, and where receptacles are not provided, such matter shall be carried away by the person responsible for its presence and properly disposed elsewhere. 76.)
F. Drive or park any vehicle on any area, except the roadways or parking
areas provided or such areas as may be specifically designated as
temporary areas by proper authority or in accordance with the instructions
of any authorized attendant who may be present.
G. Leave a vehicle or bicycle standing or parked thereon in any area
during hours when the property is closed.
H. Operate a vehicle or bicycle in a careless or reckless manner.
I. Carry or possess firearms or explosives of any description, bow and arrows or other form of weapon or trapping device which may be hostile to wildlife or dangerous to humans. Shooting into such land areas from beyond its boundaries is prohibited. (See Code Chapter
49.)
J. Picnic or lunch in a place other than such places designated for
that purpose or unduly delay or prevent the use of such permitted
areas by others.
K. Set up a tent, shelter or other temporary device or vehicle for overnight
camping, or leave any structure or vehicle that could be used for
such purpose on the lands during closing hours.
L. Play any game involving the throwing or flying of objects, except
in areas provided for such forms of recreation.
M. Bring or ride upon a horse, except in areas where permitted by proper
authority, nor allow any animals to graze or go unattended.
N. Be upon the recreation area while intoxicated from alcohol or under the influence of drugs or possess or consume any alcoholic beverage or illegal drug while within the boundaries of said recreation area. (See Code Chapter
7.)
O. Enter upon any area posted as closed to the public or use any area
in violation of other posted notices.
P. Gamble or participate in any similar illegal activity.
Q. Engage in threatening, abusive, insulting or indecent language, fighting
or engage in any disorderly conduct tending to breach the public peace.
R. Expose or offer for sale any article or merchandise, or place any
stand, cart or vehicle for the transportation, sale or display of
any such article or merchandise other than as specifically authorized
by the proper authority. (See Code Chapter 97.)
S. Post or otherwise place any sign, placard or advertisement whatsoever,
unless authorized by the proper authority.
T. Enter or exit said lands anywhere except posted and proper entrances
and exits. Persons using neighboring fields or properties will be
in violation.
U. Allow domestic animals to run at large and uncontrolled. All domestic animals will be restrained on adequate leashes not greater than six feet in length. (See Code Chapter
10.)
V. Build or attempt to build a fire, except in such areas and under
such regulations as may be designated by the proper authority. No
person shall drop, throw or otherwise scatter lighted matches, burning
cigarettes or cigars, tobacco paper or other flammable material within
the park, roads, parking areas or other areas abutting or contiguous
thereto.
W. Smoke or use of tobacco-related products within any park and/or recreation
area owned, leased or utilized by the Township of Mannington, or within
50 feet of any park and/or recreation area owned, leased or utilized
by the Township of Mannington.
X. Operate any off-road vehicle, all-terrain vehicle or dirt bike. (See Code Chapter
81.)
Parks and recreation areas shall be open to the public every
day from dawn until dusk, unless otherwise determined by the Township
Committee.
Any individual or group who desires to have exclusive or substantial
use and control of any park or recreation area for any organized activity
or event shall contact the Township Clerk for reservations and availability
no less than 10 days prior to the proposed use of the park or recreation
area.
Any person who violates any provision of this chapter shall
be subject to a penalty for each offense of not less than $50 nor
more than $2,000. Any person who is convicted of violating this chapter
within one year of the date of a previous violation of this chapter
and who was fined for the previous violation shall be sentenced by
the court to an additional fine as a repeat offender. The additional
fine imposed by the court upon a person for a repeated offense shall
not be less than the minimum or exceed the maximum fine fixed for
a violation of this chapter, but shall be calculated separately from
the fine imposed for the violation of this chapter.
