1. 
Maximum speed limits are established on portions of specified streets, as follows, and it shall be unlawful for any person to drive a vehicle on any part of a street where a maximum speed limit applies at a higher speed than the maximum prescribed for that part of the street:

Any person who violates any provision of this section, upon conviction, shall be sentenced to pay a fine of $35 and costs. Any person exceeding the maximum speed limit by more than five miles per hour shall pay an additional fine of $2 per mile for each mile in excess of five miles per hour over the maximum speed limit.

The following are declared to be hazardous grades and, upon any such hazardous grade, no person shall drive a vehicle, having a gross weight in excess of that referred to for that grade, in the direction stated for that grade, at a speed in excess of that established in this section for that grade, and, if so stated for a particular grade, the driver of every such vehicle shall stop the vehicle before proceeding downhill:

It shall be unlawful for the driver of any vehicle of the type indicated traveling upon the first-named street at any of the following intersections, in the direction or directions indicated in each case, to make a left turn and/or a right turn into the second-named street, as indicated, at any time when such a turn is prohibited by this section:

The following highways are established as through highways, thus authorizing stop or yield signs to be erected facing traffic approaching every intersection with the through highway except for those intersections with traffic signals, or with exceptions or modifications as indicated below. Every driver of a vehicle approaching a stop or yield sign authorized by this section shall stop the vehicle or yield right-of-way as required by 75 Pa.C.S.A. § 3323(b) or (c) of the Vehicle Code, as the case may be, and shall not proceed into or across the through highway until he has followed all applicable requirements of that section of the law:

The following intersections (in addition to intersections with the through highways established by § 15-206) are established as stop intersections, and official stop signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the intersecting or through street) on the first-named street (the stop street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or stop street, in the direction indicated in each case, shall stop the vehicle as required by of the Vehicle Code, 75 Pa.C.S.A. § 3323(b), and shall not proceed into or across the second-named or intersecting or through street until he has followed all applicable requirements of that section of the law.

The following intersections (in addition to intersections with the through highways established by § 15-206) are established as yield intersections, and official yield signs shall be erected (or are ratified if previously erected) in such a position as to face traffic approaching the second-named street (the through street) on the first-named street (the yield street) in the direction or directions indicated for that intersection. Every driver of a vehicle approaching the intersection on the first-named or yield street, in the direction indicated in each case, shall slow down or stop the vehicle as required by 75 Pa.C.S.A. § 3323(c) of the Vehicle Code, and then yield the right-of-way as required by that subsection of the Vehicle Code.

No motor vehicle including a motorcycle, pedalcycle or minibike shall be operated on any property owned by the Township or any other public agency or instrumentality within the Township without the permission of the property owner and a permit from the Board of Supervisors or its designee of the Township.

The following locations are designated as rotary traffic islands, and every vehicle passing around a rotary traffic island shall be driven only to the right of the island:

Any person who drives a vehicle otherwise than to the right of any rotary traffic island shall be guilty of a violation of this section, and, upon conviction, shall be sentenced to pay a fine of $25 and costs.

1. 
General Provisions.
A. 
Purpose. The Board of Supervisors of the Township of Franklin (the "Township") finds that the operation of motor- or engine-retarding devices commonly known as "Jake brakes"® (but referred to herein as an "engine-retarding device") on gasoline-, diesel- or other fuel-powered vehicles, whether or not such vehicles are equipped with proper exhaust mufflers or defective or modified exhaust mufflers or systems, creates noise through the use of such devices in the Historic District of Kemblesville that adversely affects the public health, safety and welfare of the residents of the Township.
B. 
Authority. Franklin Township finds that the operation of engine-retarding devices creates such noise and disturbance as to create a nuisance in fact, which nuisance the Board of Supervisors is authorized to prohibit pursuant to Section 1601(c.1) of the Second Class Township Code.[1] Necessary approval to regulate engine-retarding devices as contemplated by this section has been obtained from the Pennsylvania Department of Transportation in accordance with 67 Pa. Code § 179.10(20) as a condition precedent to the exercise by the Township of its authority under this section.

2. 
Definitions. As used in this section, the following terms shall have the meanings prescribed below:
ENGINE-RETARDING DEVICE
Any motor/engine-retarding device, engine brake retarder, exhaust brake retarder or hydraulic brake retarder, retarding device or system that acts as or is intended to act to supplement the service brakes or wheel brakes, that brakes on the motor, engine or other system other than the wheels for purposes of or as a means of slowing or stopping a truck, truck tractor, motor carrier vehicle, motor vehicle or vehicle.
3. 
Prohibition. No person, firm, corporation, association or entity shall use an engine-retarding device on or along the following roads or highways within Franklin Township:

A. 
State Road 0896, Segments 0050 and 0060.
B. 
State Road 3007 between the Maryland state line and State Road 0896.
4. 
Erection of Signs. Signs shall be erected on highways or roadways entering the road segments as identified in Subsection 3 above, notifying persons of the prohibition against the use of engine-retarding devices in the Township, which signs and their specific locations shall be in compliance with any applicable regulations of the Pennsylvania Department of Transportation.
5. 
Penalties. The enforcement of this section shall be by action before a Magisterial District Judge in the same manner as provided for the enforcement of a summary offense. Any person, firm, corporation, association or entity violating any provision of this section shall, upon conviction, be subject to pay a fine not to exceed $1,000, reasonable attorneys' fees incurred by the Township, plus costs of prosecution and, in default of the payment thereof, be sentenced to undergo imprisonment as allowed by law for the punishment of a summary offense.
6. 
Enforcement. This section shall be enforced by any law enforcement officer of the Commonwealth of Pennsylvania or any authorized agent or code enforcement officer of Franklin Township.
