1. 
As used in this Part, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
PARK(S)
Unless specifically limited, shall be deemed to include all parks, playgrounds, recreation areas, open space, recreation structures/areas, facilities and also entrances and approaches thereto, and all other land or property or structures under the jurisdiction of Franklin Township now or hereafter operated by Franklin Township for park or recreational purposes.
PERSON
Any natural person, corporation, organization of persons, company, association or partnership.
RULES AND REGULATIONS
Any rules and regulations hereby or hereafter promulgated by Franklin Township under the authority herein conferred.
TOWNSHIP REPRESENTATIVE
The Board of Supervisors, Township Manager, Assistant Township Manager, or any other person appointed by Franklin Township's Board of Supervisors, Township Manager or Assistant Township Manager to act on their behalf.

Park hours shall be sunrise to dusk, seven days per week, excluding major holidays. Any person(s) found within the park after these times shall be subject to the penalties herein provided by this Part, unless they have been granted permission in writing by a Township representative. In addition, special events approved by a Township representative may include activities in the park during periods of time the park is normally closed. Any park operated by Franklin Township which becomes hazardous for public use due to weather, water, fire or unforeseeable conditions may be closed at the discretion of a Township representative.

1. 
The following rules, regulations and prohibitions shall apply to any park operated by Franklin Township:
A. 
Possession, sale and/or use of any alcoholic beverages or illegal drugs is prohibited.
B. 
Disorderly, boisterous or immoral acts or practices are prohibited.
C. 
Using threatening, abusive, insulting, profane or obscene language or words is prohibited.
D. 
Disturbing the peace by any conduct as to annoy any other person using the park for recreational purposes is prohibited.
E. 
The throwing of stones, rocks, sticks or similar missiles is prohibited.
F. 
Begging or soliciting is prohibited.
G. 
Gambling is prohibited.
H. 
Discarding of trash, garbage, paper, bottles, cans or other litter is prohibited, except into containers provided for that purpose.
I. 
Damaging, defacing, destroying, removing or moving Township-owned property, trees, shrubs, plants, turf, signs, buildings, structures, lights, fixtures, benches, seats, picnic tables or other equipment, material or property of the Township is prohibited.
J. 
Contamination of any waterway by any means is prohibited.
K. 
Using skateboards is prohibited.
L. 
Hitting of golf balls within a park is prohibited.
M. 
Offering anything for sale is prohibited, unless written permission of the Township has been granted permitting such activity.
N. 
Building of any fire is prohibited, unless written permission of the Township has been granted permitting such activity.
O. 
[1]Careless and unsafe operation of any nonmotorized human powered equipment, such as bicycles, tricycles, or roller blades, is prohibited.

Editor's Note: Former Subsection 1O, which prohibited the use of charcoal or gas barbecue grills, was repealed by Ord. No. 2019-03, 12/18/2019. This ordinance also provided for the redesignation of former Subsection 1P through AA as Subsection 1O through Z, respectively.
P. 
Climbing on fences, backstops, buildings, pavilions, trees and storage containers is prohibited.
Q. 
Any actions endangering the safety of others is prohibited.
R. 
Carrying, exploding or discharging any firecrackers, fireworks, slingshots, arrows or other missile propelling instruments, explosives or other dangerous weapons which have such properties as to cause annoyance or injury to any person or property is prohibited.
S. 
Hunting for, capturing or killing, or attempting to capture or kill or aid or assist in the capturing or killing of, in any manner, any bird or animal of any description either game or otherwise, unless written permission of the Township has been granted permitting such activity. Fishing pursuant to a lawfully issued Pennsylvania Fish and Boat Commission license is specifically permitted without any further approval by the Township.
T. 
Discharge of a shotgun, rifle, pistol, bow and arrow or firearm of any kind, unless written permission of the Township has been granted permitting such activity and is permitted by applicable law.
U. 
Disobeying a proper order of a police officer, disobeying, disregarding or failing to comply with a rule or regulation, warning, prohibition, instruction or direction given by an authorized person and posted or displayed by sign, notice, bulletin, card, poster or when notified or informed as to its existence by a Township representative is prohibited.
V. 
Playing music from car radios or handheld radios which causes offense to others is prohibited.
W. 
Operating commercial vehicles, unless providing authorized services, is prohibited.
X. 
Holding any public meeting or rally with more than five persons or engaging in any marching or driving as members of a military, political or other organization without first obtaining a permit from the Township. Permits may only be issued when a statement of information, including the name of the organization, its purpose, number of persons expected to be invited, expected duration and name(s) of person(s) in charge have been given to the Township.
Y. 
Pets must be kept on a leash eight feet or shorter and under control of a responsible person at all times. No pets are allowed on any playgrounds, ball fields, volleyball or tennis courts at any time. Pet owners are required to clean up after their pets and deposit any used pet waste bags in a trash receptacle.
Z. 
Individuals riding horses or bicycles shall stay on marked designated trails.

1. 
The following traffic regulations shall be in force and effect at any park operated by Franklin Township:
A. 
The Pennsylvania Vehicle Code Act of 1976, P.L. 162, No. 81, as amended, Title 75 Pa.C.S.A., is hereby declared to be in effect with respect to the operation of vehicles within the park.
B. 
Vehicular travel at a rate of speed exceeding 15 miles per hour is prohibited. Operating a vehicle in a reckless or negligent manner or in excess of the posted speed limit is prohibited.
C. 
Driving or operating any motor vehicles beyond the designated parking areas and roads is prohibited. The use of snowmobiles, all-terrain vehicles (ATV), dirt bikes, go-carts and other similar vehicles is prohibited. Motor vehicles are permitted to park in designated parking areas, but must be removed upon closing. No automobile, truck or motorcycle shall be left in any park after closing hours without special written permission by a Township representative. The Township shall be under no obligation to reopen the park or any parking lot, road or gate locked after closing hours in order to allow said vehicle to be removed during a period of time when the park is closed. Leaving said vehicle in said park after closing hours without written permission by a Township representative shall be a violation of this Part. In addition, any motor vehicles entering the park are subject to inspection by law enforcement at any time.

1. 
The following general provisions shall be in force and effect at any park operated by Franklin Township:
A. 
Parents are responsible and will be held accountable for the safety and behavior of their children. (While these parks are maintained and operated by Franklin Township, supervision will not be provided.)
B. 
Users of these parks shall respect the rights of others and conduct themselves in a manner acceptable and becoming to others. Users are required to follow the directions of a Township representative.

1. 
Any person found guilty of a violation of this Part in a summary proceeding in the manner for enforcement under the Rules of Criminal Procedure before a Magisterial District Judge shall pay a fine of not more than $1,000 per occurrence/act, plus the costs of prosecution and imprisonment not to exceed 90 days or as may otherwise be provided by law for summary offenses. Each day that a violation of this Part continues or each section of this Part which shall be found to have been violated shall a separate offense subject to per diem fines.
2. 
Any person found guilty of a violation of this Part in a summary proceeding before a Magisterial District Judge shall be required to pay for any repairs to any and all vandalized areas.

The Board of Supervisors of Franklin Township is authorized to establish additional rules and regulations as deemed necessary.

1. 
The use of all parks shall be on a first-come, first-served basis, unless otherwise reserved:
A. 
By annual permission granted by the Board of Supervisors.
B. 
For school, college or league athletic games, practices, contests or exhibitions approved by a Township representative.
C. 
For regularly scheduled municipal recreation programs.
D. 
By permission granted by the Township for a specific requested use.
2. 
Park fees will be based on fee schedules available at the Township office.
